ive had the police round and what ive said in my statement tallys up with the witness in the car behind me which is good.the police are looking to nick the driver for unsafe driveing or somthing along those lines.

this is what happend ive come off a round about and was following 2 cars the road is a bit twisty for about a mile then straightens up.all the time through the twisties the car that hit me had his left indicator on which i dont know why.he also told the police that he could hear i was behind him, once the road had staightend out ive gone for the overtake as the cars were moving at around 25 ish,as i got along side the car that hit me he has lurched out to over take and wiped me out.the police man didnt want to tell all that happend when the car first hit as he said im prob best not to know but i ended up sliding into a brick wall with the bike following me then landing on me,

it all happend so fast and i dont recall the car hitting me just it lurching over.all i can remember after is laying on the floor with lots of legs in my sight and i could hardly breath.

the reason i dont want to ride any more is i cannot put my misses and 2 kids through that again seeing me in ICU for 4 days with tubes and a mask on must have been hell for them.

i believe that my leathers, boots ect saved me so make sure you wear it all the time peeps.

i will still visit the forum from time to time all tho i wont be a biker anymore as you are all a nice bunch of peeps as the messages shows.

once again many thanks to thos who have posted on this thread

just an update

police phoned me last night and told me they are not pressing charges as the driver whilst in the formal intrerveiw has now said he did’nt know i was behind him and he mirrior signal ect then pulled out.witness has now said she cant say who was at fault.

the police man told me he thought the driver had been advised to say nothing about him hearing i was behind him which is not what he said at the roadside.

i have legal cover with mce who came around when i came out of hospital and they contacted work with loss of earnings forms.ive only returned to work last week doing every other day and hope this week will be a full one.

told me to keep all my bills ect

told me to get prices for second hand lid, leathers, gloves and boots

will be speaking to them in the morning.dunno what happens now but i feel a bit angry about it all as it all could have turned out alot worse

“told me to get prices for second hand lid, leathers, gloves and boots”

Why second hand? Never buy a second hand lid because you don’t know how it has been treated (dropped). When I had my stack, I got money for brand new gear - not second hand stuff. These lawyer should be on your side, not telling you to get used kit. I better stop typing cos its making my blood boil

yeah thats what i thought

I hate insurance…Glad you are ok (ish) though…Sounded nasty :frowning:

cheers, ribs still bit sore

mate, i dont want to say do this or that as you had a shock and you probably still feel it,
but try not to get the all situation get the best of you,
if they’re so quick to put insurance prices up because of claims at least make it worth the money
try not to give up,
this already had you giving up biking for good so its worth a good fight for your rights.

My blood is boiling too
Your accident could have been a fatality and you are lucky but that doesnt mean they can just leave it.
I wouldnt imagine the police would just leave it for the sake of paperwork.
Is is worthwhile contacting a legal team for advice eg Rider Support

And you definitely should not accept second prices
You cant go and buy second hand goods (if you were riding again) and its not your fault that you need to get them
I am sure I got new prices for everything (perhaps minus 10% for wear and tear but I had bought them with a discount anyway so the retailer just gave me paperwork to show the replacement costs at full retail)
Have they admitted liability?

I am really gutted for you
Perhaps someone in the police here could advise better on this.
I am sure they need really strong evidence to convict for reckless driving but where is the statement about hearing the bike and why has it changed?
I was at a prehospital trauma course recently and the police who came to talk to us said that they hate it when someone who caused an accident especially a fatality “gets away” with it so I doubt this is just a case of laziness…I will be interested to see what our biker police mates have to say

thanx

i just dont know where it goes from here

i’m going to suggest riders support too.

and the quote of you getting second hand gear,
thats just a joke.
i cannot believe any reputable BIKE insurance would even go and suggest that option. i think may be borderline illegal.

he has not admitted liability and i dont know why the statement taken at the roadside counts for nothing

fletchers solicitors part of mce are dealing with it.i tried call them earlier but was engaged and was late in the day.

the police also told me that it might be a civil case.what does this mean

It means they aren’t going to do feck all about it and you have to have it out in court.
