I honestly wouldnt worry about it too much I did the same thing years ago but didnt stop as the person looked fine and also it was their fault so figured they wouldnt report it. Later that night I did the same thing and called the police to report it. Nothing ever came of it because they realised I made an error of judgement and also it was the other parties fault.
Ok, so you did not stop at the scene - you were probably shaken up and not thinking straight. However, you seem to have done just what Direct Gov website says to do in this circumstance:
If you’re involved in an accidentIf you have an accident that causes damage or injury to any other person, vehicle, animal or property, you must give both your own and the vehicle owner’s name and address, along with the registration number of the vehicle, to anyone having reasonable grounds for requiring them.
If you don’t give your details then you should report the accident to the police as soon as possible within 24 hours. You must also report the accident to your insurer, even if you’re not intending to make a claim.

I’ve kind of been in the same situation before - a car hit me and didn’t stop. I rang the police and was told that they had 24 hours to report it and to inform my insurance company as they would try to find the driver - if he did not report himself within 24 hours.
So I don’t think (although it was a few years ago!!) that you can get charged for leaving the scene - if you contact police within 24 hours.
There could be loads of reasons why you wouldn’t want to stop - intimidation, safety (especially lone females), didn’t realise how serious it was etc - so I wouldn’t worry too much about being charged for leaving the scene - just depends on how ‘injured’ the guy is…
at least you did the right thing when you got home and calmed down
if it does go to court your solicitor can argue that you were in shock and did the right thing the moment you could
Mate. You sure this wasn’t planned by the guy? Sounds like he wanted to get hit?
you reproted it as soon as practicable, and he ran into you, they will struggle with an conviction trust me.
My understanding is there are two offenses, failing to stop, and failing to give personal details. A defence for the second one is that you produced the details to the police as soon as practicable and at least within 24 hours. There is no defence for the first one.
I suspect that as you provided the details soon after the incident the Police are unlikly to pursue you for his as long as everything else is in order as the usual reason for not stopping etc is lack of license or insurance or trying to avoid blame.
I think this hinges on what you mean by “saw him moving”.
It is an offence to leave the scene of an accident if there is damage to property, personnel or animals. If what you saw in your mirrors was the pedestrian brushing himself off and calmly walking away as if nothing had happened, then you could argue that you had no grounds to suspect that an injury had been caused, therefore you were legally entitled to leave the scene. CCTV footage would indeed be useful in this instance, to support your claim.
If, however, by “moving”, you mean he was lying in the road screaming and writhing around in agony, that would be a very different matter.
So the question is - what exactly did you see in your mirror?
Oldguy is a genious asking these questions. And you would be better off believing me that you ARE traumatised. Visit your GP immediately, better even take time off work if you can. Describe the events as you’ve done here, and seek for his advice on how to cure your anxiety, loss of confidence and inability to concentrate on anything but this incident. You may not realise that it is so bad that you’d have to take time off work and some prescriotion medication.
I do hope this turns out OK for you. What a horrible situation and one we could all be in as some pedestrians take way too many risks.
I suppose if you’d looked in your mirror and seen him NOT moving then you’d need to be more worried but maybe you just didn’t tell the police the whole story. Maybe you turned the bike around as soon as it was safe to (not always easy in London traffic) and when you got back the guy had gone?
You looked in your, he was moving and DIDN’T APPEAR TO BE SERIOUSLY HURT. That’s to say he was getting up or had got up. You and your bike were ok, he caused the accident so you carried on your way, reporting the incedent when you got home as is suggested on the Govt website.
Tell your insurance company, and ask them who deals with their legal claims, then take advice from them.
You do have trauma otherwise you wouldn’t be writing on here.
ive told my insurance they said i don’t have legal cover for this matter but if he claims im covered. its just a case of waiting to see what happens i should get a letter from the cops in 7-10 days then i can call up and find out whats happening.
Ive told the truth about what i saw in the mirror that i saw him falling over was scared and legged it as i panicked and didn’t know what to do until i got back home had a chance to calm down and then called the police about the matter.
yes im in shock not happy being on the road always thinking about it and today has horrible being at work but i cant claim against him as im not fully comp and really cant be bothered with suing the guy. im alive in 1 piece and so is my bike i should count myself luck. lets just hope the courts let me off the same
Definitely have a chat with a lawyer, unfortunatley you are probably going to need one.
Not a good situation, and one of those that if you had not reported yourself to the police you probably would have gotten away with it…
PM’ed ya
If you hear from the police get some legal advice… with a bit of luck this will get marked up for No Further Action as it’s probably his word against yours. Unless of course there’s CCTV or another witness.
Personally I’m sick of these fugging London ped’s they’re always running through traffic. Always pisses me off when you see a mother with a buggy + walking toddler run for it when they’re standing 2 mins walk from a crossing!
I had a situation a few years ago when I was filtering and somebody ran into me, knocked me off, damaged my bike and she broke her hip.
I repaired the bike myself, I didn’t claim from the girl but about 4 years later I got a personal injury claim from her. My insurance company handled it but it was pretty upsetting as it had been all her fault.
I would agree about saying that you saw him moving and “HE LOOKED OK TO ME” but I though I should report it when I got home. Did the police caution you before you made the statement to them? If not then there’s a good chance you could say you were distressed and not sure what you were saying in which case the probably wouldn’t be able to use it in evidence. The good thing is that you contacted them quickly, they didn’t have to come looking for you, which will get rid of the “failure to report an accident” however “failure to stop” is the one you may have problems with.
Guess who’d been watching daytime TV then! 4 yrs later… what a joke… I had a fraudulent PI claim against me… took 2 yrs to sort it out, thankfully the bitch didn’t get a cent!
Just reading your post sorry to hear what happened , obviously these things happen well anything can happen to be honest but pedistrians trying to cross the road when lights are red or the ones I find so dangerous is pedistrians pulling out from parked cars or buses the amount of near misses I’ve had with them luckily aint been in the situation you experienced but I can understand why you done it , it’s a natural reaction everyone reacts different to these things but you done the right thing in contacting the police , you get people in hit and runs which leave people dead , so of course u did the right thing , all part of riding mate hopefully everything alright now just take it easy and don’t let that get to you because there’s always gana be risks with driving just learn from experience
I would do the exact same thing, go to GP say you are unwell, as obviously you are not. Also did you sign anything? Nope you just called the station. When you will eb asked to write what happened make sure you state the guy ran straight at you, looked as if they were trying to attack you so you tried and avoided them and probably hit them but no damage was done to either you or your bike an since bikes get damaged at teh slightest hit… that should prove it.
Hell I don’t know anything but I was told that unless you have an “independant witness” the case is dropped lol.
