You are legally entitled under the Data Protection act to view the CCTV footage. Make your request in writing which must be answered within 40 days. Failure to do so is in breach of the act, but would also add weight to any argument of negligence on their part, as serviceable CCTV should be part of their terms and conditions.

Surely under the circumstances its Rixy’s property under their duty of care. The fact that the facility is advertised as “secure” parking implies that the ellements that make it “secure” are in situ and functioning. It cannot be described as other wise in relation to their terms and conditions. Anything found to be non function, or unable to be produced due to failure could be considered negligent.

Fingers crossed they at least try to resolve this. The introduction of parking charges by Westminstef CC taught me that the parking industry is a swamp and companies are keen to present a positive image.
