Wow, we have an insight into both the enforcement, and prosecution side of the law now, this is surely a very good thing! It should help dispell any myths, or assumptions that we work on. So do we all agree that it’s the Judges who are out of touch?
I think the problem is more criminals are interested in the legalities of law than inoccent people.
And for that reason the criminals are able to ‘get off’ or recieve lighter sentences.
If we all knew the loop holes, we would stand a better chance…
Top work there Lofty…pitty the judge is only gonna slap his wrist and give him a bag of sweets to say sorry
I don’t think it is the Judges’ fault either.
There is a distinct lack of prison space (which nothing appears to be done about). This means the courts get told to use other sentencing powers, such as drug treatment and supervision orders. These rarely work and there is so much red tape involved that it takes ages for any breaches to be sorted out. Everyone, the police, CPS, probation etc are under resourced so the problem escalates.
Then add the Human Rights Act and other legislation that makes life harder. The only people to win from law like this are the criminals as the processes are slowed down and we are overloaded with paperwork to justify why we want to go after someone.
The whole system needs to be reviewed (but you know it won’t happen…)
Until then, do everything you can to keep your loved ones and your bikes safe.
