Pulling in to a tesco petrol pump to topup, applied front brakes next thing I know I was lying on the floor. Broke my side lamp.
The tesco staff just stood there like statues, one old man helped me and I asked him to help me pick the bike up which he got a shock how heavy it was.
As I look on the floor it was full of diesel…called the manager and had a go at her. She said they will pay for the damage and also I hurt my back.
Get some legal advice. Go to the doctor for a check up and don’t agree to any settlement until you have done so. Make sure the back pain doesn’t develop into something else either. Damned right they are going to pay. It’s negligance and you can sue their arse off! Do not let Tesco get away with it - they are one of the most unethical companies in this country.

Do sense a hint of a crusade there bandit bird…bad to fall off and at nil speed and in front of a load of people…bad to damage bike…was it really there fault, should you not have seen the spill, its the bugger that spilt it that is the nuisance and did not report it or throw sand on it that I would be after…always too easy to blame the man in charge (or the store in this case) rather than the man who did the dirty deed…
I filled in a report with the manager…I know its negligence because in london the petrol pump staff are very active and make sure there is no diesel next to the pumps. most of the time.
at the time you dont feel any pain only later u get the pain.I know I hurt my side because I fell on the pump kerb with the bike on top of me. The staff did not move an eyebrow.
I will go to the doctor tommorow so I can make claim later.
Not a crusade (although I’ve been on few:) ) but I do have experience with this kind of thing. Sued the council and won a case for negligence. Had two car accidents etc. My ex was rear ended and the insurance company said it was whip lash, several months later after physio and an mri scan, he had two slipped discs and needs an op. Something that might seem to be soft tissue damage could infact be alot more serious and really mess your life up for a while. With regards to the fuel spill - yes the bugger should have reported it, or rather they may of but the attendents didn’t do it. Who knows? They do.It’s not a ‘where there’s blame there’s a claim’ crusade - it’s a they failed to make safe a public area and as a result injury and damage has been done to a customer. Petrol stations have to adhere to some strict health and safety regulations, which they have breached in this instance. If they are smart, they will bend over backwards to make sure that the damage is sorted out because they know easyrider can sue their arse off and report them to the H&S executive. Fuel spills are notorious - you don’t see them until too late. It’s lucky it wasn’t an elderly customer who slipped over and broke a hip (or something) or a pregnant woman - Tesco know this and should do all it can to make amends. However, it doesn’t hurt to know your rights. Not that I’d goto a solicitor or ring one of those accident firms… your insurance company should be able to do it all for you. Did you know that part of the ‘legal costs’ cover on your policy (definitely on cars) can be used for any legal matter? My parents just used the £50k legal protection on their car insurance to take the Government to high court. Not many people know these things… and these companies know this and take advantage.
I hope your injuries are only bruises. If you hit the pump, then I suspect you hit the edge of the kerb around it - ouch! If you need any help writing letters, let me know.
hmm all good points…I think there are two points as i said in my letter…
One is our own individual need to be careful…not to spill diesel and not to fall over on it…
the other is the service stations need to be careful…to keep an eye open for spills and to make sure they sand any that do occur…bet there are no signs about cleaning up or reporting pills…

Sorry to hear of your off, but you cant seriously be thinking of sueing a petrol station for a spash of spilt petrol?

Must agree!Now that most gas stations have multi fuel pumps I take that little bit more care when pulling up by one as there is always a chance that the floor has diesel on it.
Have highlighted the bit in my last post saying I’d wouldn’t sue but go thru the insurance.
Know your rights and damn right go for compensation if your injuries and damage are a direct result of whatever company is responsible. I’m not saying do a sue mcdonalds for $100 for a hot apple pie type of thing. I’m on about making sure your physio etc are paid for and the damage of the bike is sorted. If you lose time off work, that should be accounted for too.
There’s a couple of drops and then there’s spills. It’s the forecourt attendants job to make sure it’s in order… it wasn’t which is why Tesco are at fault.
I hear what others are saying but I agree with bandit girl…My bike was damaged and i got a nasty pain in my hip and back…
Also what really pissed me off is the attitude of the staff who could see me lying on the floor and none of them moved or bothered asking me what happened Just standing like zombies. One old man helped me I forgot to take his details as witness. I was really angry because there was a lot of diesel not a small patch. If they dont give a **** about us then I have every right to get compensation from them.

thanks for ur advice…I will go to the docs tommorow. to get some pain killers as you know they dont have any cure for back injury. Also to make my case stronger.
you mentioned about going through insurance. I have not mentioned this to them yet. ALso I have only third party only
Can you give me some more advice on what my next step should be so I can get some compensation.

They have aduty of care to anyone visiting their premises and if thet havent taken care to mop up/clean spills then they are liable - same as a broken bottle of spaggetti sauce in store if you slip on it -they are liable- a decent solicitor will give you proper claim advice though.
Had to sue my work as they wouldnt pay me for an industrial injury when they knowingy used damaged equipment “just to get the job done” cost them £7,000 instead of a months wages!!
