This is what everyone’s up against. Councils have this ability to deny culpability.
My daughter had a bad fall recently on a pothole in a pavement that turned out to be on private land (although it looked like a public highway). Turns out that suing the owner of the land is far easier. Her solicitor said if it had been council owned it would have been next to impossible.
