Why do you say that? If you’re going around your lane on a roundabout and someone pulls in front of you from a different lane with no warning and then stops suddenly (for whatever reason), I don’t see how you could reasonably be expected to have foreseen it and allowed enough stopping distance. You only have to give way to vehicles on the right that are already on the roundabout, and only when you’re entering that roundabout. When this happened both vehicles were already on the roundabout and were now leaving it. Yes, the other driver has a reason to stop suddenly, but he should not have driven in such a way so as to cause problems for other road users. He should have been aware of the pedestrian crossing and travelling at such a speed to allow him to come to a stop without having to do so ‘suddenly’.

One thing though. Did the road you both turned into have single or double lanes? If double then he has no excuse for not staying in his lane when coming off the roundabout and clearly didn’t check properly before pulling into your lane.

it was 2 lanes coming off… he just decided to cut the corner into my lane… unfortunately… cutting me up aswell… when he got out of the van… he thought i was a van hitting him?.. & thought i had already got past him?.. so i assume i was in his blind spot when he did this maneuver… otherwise he would of seen i hadnt got past him !? :crazy:

i had a empty lane to myself… i had no vehicle behind me in my lane… & the nearest vehicle in front of me must of been about 50 metres ahead of me… he cut me up by basically side swiping me… my body was level with his rear wheel… i braked enough to miss his rear bumper clipping my front wheel… then he stopped instantly… i had no safe braking distance left… his van took it all up !! :pinch:

:crazy: eek… is when/how i was positioned when he started coming towards me… i was going to stay in my lane onto the road we were coming off… as i was heading towards Elephant & Castle Roundabout to go to Chas Bikes !! :pinch:

On a roundabout you are supposed to give way to those coming from the right. Your only meant to take the inside lanes if going ahead or to the right.

Only case I can see were it would defiantly not be your fault or part fault would be the van doing dangerous driving or without due care, if in there was a second outer lane of the exit he didn’t use, or the driver was driving well over the speed limit to over take you to cut over into you path.

But let’s be practical. Far too many car drivers pretend to be the Stig on roundabouts and go for the racing line off the exit. So he probably was at fault and a twat too boot.

Take it from a biker who just realised not only that most of his teenage biker friends are dead now from bike accidents, but so are most of his acquaintances he used to see down the pub too. Just be wiser next time, car and van drivers are brainless until proven otherwise. Be safe, drive with eyes open, or the fool will hit you.

It is worth noting that this is not a roundabout. Vehicles cannot pass from St George’s Circus round from the Borough side to the Westminster Bridge side.

This is the reverse view of the crossing where the van stopped. From the description the van came from the far left, and the motorcycle entered the junction from the road behind the bus on the far right.

I would argue normal lane rules apply rather than roundabout rules as the road has two lanes all the way round including at the exit to London Road. The signs say the correct lane for London Road is the right hand lane as you pass through that junction.

If the van moved from the right lane on the exit to the left without checking it was safe to do so then there is a degree of fault.

Even with the second drawing, still time to avoid the van, as said it was seen cutting across, so why not slow down, even though it has cut across lanes is wrong.

as others have said get some witnesses if you can.

Be like a strait road then. Van overtook at speed and cut up the bike on the left. Case of driving without due care and attention along with reckless driving as they hadn’t filtered for the turn prior to the turn. That should be enough to fix liability?

Very hard to plan against such morons.

Thanks for all the input… its now in the hands of the insurers… & what statement the van driver has given… & wether there are any similarities & truth that match mine… … … fingers crossed eh !! :pinch:

id just like to state… the only avoidance was what i had done… braking to avoid being side swiped… quite funny though when the solicitors said that it would of been better for me to of got hit… too prove guilt due to ‘side’ damage… … … Hmmm… no thanks… id rather be £’s out of pocket than in hospital typing this… or worse !!! :hehe:
