Insurance take 2

Ok, so its got to 3 weeks now and nothing has been sorted with my insurance.

Apparently, the guy that hit me has said that i should claim off the hire cars insurance and not his. The people who are ‘supposedly’ helping me have said they cant do anything and to go back to my insurance.

Now, is it me is is this becoming a legal matter as nobody will give me any answers and i have a car in bits at home. What should I do?

Should I involve the police as its been over 3 weeks now or do I go trotting back to my insurance and see if anybody there is capable of fooking sorting themselves out??

As I am still without a vehicle and mine is still fooked!!

I am so bovvered!!!

Somebody for god sake please tell me what I should do as the people that should be helping cant!!!

cheers

If somebody drove into you then you have a right to claim from his insurance company (or him directly if no insurance), all you need to do is to ring them and tell them that this chap in car xyz drove into you, it’s his fault and would they please send you a claim form.

I would tell the plod too, just to cover your back. I would also ask plod to confirm that the details he gave you are his correct details, they probably won’t give you his name or address but if you supply all that they can give you the yay or nay.

You probably also need to tell your own insurance company and they may also help with confirming his details on the insurance database. Tell them that you are not making a claim on your own policy, not at this stage, or they will start that process off.

You also need to get the car to a repair centre/garage to get an estimate of the damage - get a written quote for all the damage. Add on your expenses, taxi/train etc loss of earnings etc and that gives you the figure to claim for.

If you have legal protection then they will help with all this.

I’ve not read the original thread so sorry if you’ve already done some of this or know it already, sorry

Jobie,

I could be wrong but as it was a rental car you claim of the rental company then the rental company claim off of the driver…

the rental comapnies vechiles should all be insured… any help let me know as I work for a claims company and can speak to a few people and see what they say (I work in the IT dpet hence me not knowing).

Doh ! Didn’t spot the hire car !

The guy has said to claim off the hire cars insurance. But he wont give the details of the hire company.

So Im stuffed. I dont know whether to get the police involved as i have his name + address + insurance policy number.

Im just getting reali fooked off as Im left with a mangled car and its not my fault!!!

If he is witholding information definately time to inform the police i would say

Ok, cheers everybody.

I’ve never had to deal with any of this before so its nice to get a good word or two.

I’ll tell my insurance and the police and see what goes from there.

jo are you third party f+f or fullycomp??

as the accident was your fault it is the hire car company claiming off of your insurance! not the other way round!

if your only third party then your damages come out of your pocket!

Third party.

It was his fault, he just wont talk to his insurance company.

He hasnt said it was my fault, he just wont give out any details of the hire company.

Well good luck on that I was third party when I got hit and they were as about as usful as a chocolate teapot…

Ok if he is refusing to give the details, claim against him he will soon hand them over…

That or it was not a hire company…

Do you have contact details of the driver?

PM me if you want a chat…

I’ve got his name, address, insurance policy number, etc.

Reali though, if it hasnt been dealt with after 3 weeks, my insurance told me its automatically his fault and it becomes a legal matter.

jo, if you hit someone from behind then it is your fault! unless you can prove that he’s brake lights where faulty or prove any other factors that make it he’s fault!

speak to the police and pass them his details! but i think your damages will be coming out of your pocket

As he hasnt reported it for 3 weeks, it automatically becomes his fault, as I was told by insurance.

I spose its just a case of talking to my insurance now and seeing if somebody knows what the fook they are doing!!!

hang on!! who hit who you hit him or he hit you

he reversed into me.

And hasnt said that i hit him, he just wont talk.

do you have any witnesses?

No

I know the odds are stacked against me. But the guy hasnt said it was my fault. He wouldnt contact his insurance company or anything.

I think he knew it was his fault so tried to keep quiet. Even though he said to contact the hire company, he still didnt say it was my fault.

So I dunno.

If you have his insurance details, then give them to your insurers and they should then persue the claim on your behalf, especially as you are claiming that it wasnt your fault.

I dont know about the 3 week rule, however, it is an offence to not have insurance or give the correct details at the scene of an accident and as he seems unwilling to provide the details of the hire car company (in theory it should be insured through them) then he is breaking the law and you wouldnt do any worse than to involve the police.

His reluctance to provide the hire car company details worries me. Was there any damage to his car. I am guessing not, and this would explain his reluctance to provide their details as I bet he gave the car back and didnt disclose that he had an accident.

Either way, his actions are breaking the law, go get him girlie!

Ooooo, don’t spure me on.

I understand that it may look like I went into him, but if he refuses to give out the insurance details, that must mean hes trying to hide something!!

I refuse to let this one go as I will post up a bit later exactly what state my car is in and you’ll understand then!!

Fooking be-arsterd!!!

So in this case, i am not taking the blame.

Theres no damage to his car as he had bull bars on the back.

as ****e as it sounds I would lick your wounds and walk away, I had this a guy pulled out on me I hit him in the arse but because there were no witnesses i had no choice but to leave it because it would have been almost impossible for me to prove what he had done…

It is a ****ter and i would just put this down to experience… I personnally (especially being 3rd party) would not risk it, as it could just end up costing you more…
