Ok, so its got to 3 weeks now and nothing has been sorted with my insurance.
Apparently, the guy that hit me has said that i should claim off the hire cars insurance and not his. The people who are ‘supposedly’ helping me have said they cant do anything and to go back to my insurance.
Now, is it me is is this becoming a legal matter as nobody will give me any answers and i have a car in bits at home. What should I do?
Should I involve the police as its been over 3 weeks now or do I go trotting back to my insurance and see if anybody there is capable of fooking sorting themselves out??
As I am still without a vehicle and mine is still fooked!!
I am so bovvered!!!
Somebody for god sake please tell me what I should do as the people that should be helping cant!!!
If somebody drove into you then you have a right to claim from his insurance company (or him directly if no insurance), all you need to do is to ring them and tell them that this chap in car xyz drove into you, it’s his fault and would they please send you a claim form.
I would tell the plod too, just to cover your back. I would also ask plod to confirm that the details he gave you are his correct details, they probably won’t give you his name or address but if you supply all that they can give you the yay or nay.
You probably also need to tell your own insurance company and they may also help with confirming his details on the insurance database. Tell them that you are not making a claim on your own policy, not at this stage, or they will start that process off.
You also need to get the car to a repair centre/garage to get an estimate of the damage - get a written quote for all the damage. Add on your expenses, taxi/train etc loss of earnings etc and that gives you the figure to claim for.
If you have legal protection then they will help with all this.
I’ve not read the original thread so sorry if you’ve already done some of this or know it already, sorry
I could be wrong but as it was a rental car you claim of the rental company then the rental company claim off of the driver…
the rental comapnies vechiles should all be insured… any help let me know as I work for a claims company and can speak to a few people and see what they say (I work in the IT dpet hence me not knowing).
jo, if you hit someone from behind then it is your fault! unless you can prove that he’s brake lights where faulty or prove any other factors that make it he’s fault!
speak to the police and pass them his details! but i think your damages will be coming out of your pocket
If you have his insurance details, then give them to your insurers and they should then persue the claim on your behalf, especially as you are claiming that it wasnt your fault.
I dont know about the 3 week rule, however, it is an offence to not have insurance or give the correct details at the scene of an accident and as he seems unwilling to provide the details of the hire car company (in theory it should be insured through them) then he is breaking the law and you wouldnt do any worse than to involve the police.
His reluctance to provide the hire car company details worries me. Was there any damage to his car. I am guessing not, and this would explain his reluctance to provide their details as I bet he gave the car back and didnt disclose that he had an accident.
Either way, his actions are breaking the law, go get him girlie!
as ****e as it sounds I would lick your wounds and walk away, I had this a guy pulled out on me I hit him in the arse but because there were no witnesses i had no choice but to leave it because it would have been almost impossible for me to prove what he had done…
It is a ****ter and i would just put this down to experience… I personnally (especially being 3rd party) would not risk it, as it could just end up costing you more…
