I got rear ended, what happens now?

Update:
Finally! 3 and a half months since the 3rd party admitted liability, and almost 4 months since the accident, this week I’ve finally received the settlement and received my written off bike back. Still not a whisper regarding the cost of replacing my kit, but if that will take “significantly longer” than the bike settlement I’m hopeful I might get it in time to replace my replacement kit.

They totally lowballed the settlement, which I assumed they would, but more annoyingly my bike was in a right state when they gave it back to me. It was covered in rust and dirt (it had clearly just been left outside to rot for the duration) and they had somehow managed to smash a big hole in one of the fairings.

In any case after a LOT of cleaning, £40 of used parts off ebay, a new set of tyres and 2 days of spannering and I think the bike’s ready to go back on the road. Just got TPO insurance from Monday and crossing my fingers it passes the MOT.

It’s strange that before it was just a chair with wheels that took me to work. Now, after all that’s happened to it and it just keeps going, I quite like it’s slightly wonky panels and its duct taped fairing. I’m glad to have it back. Wish me luck for its MOT :slightly_smiling_face:

Actually that isn’t the worst. Glad you get a result.

I’ve heard that some recovey don’t give a rats and damage the bike further through carelessness.

I can confirm first hand that “Copart” are one such company (that’s who Plantec stored it with) turns out their main game is actually auctioning written off vehicles. I guess they weren’t storing my bike for me, they were holding one of their auction lots until the paperwork came through

I’ve just heard back from my complaint about the extra damage. Apparently my settlement (from the 3rd party insurer) also includes repair costs to the damaged part of the bike so Copart will not be doing anything about it. (I think what he meant to say was that my payment is for a total loss write off.)

If Copart even threaten to look at your bike, unless you’re planning to sell it as salvage I’d run a mile. Apparently they think it’s perfectly acceptable to return it to you in whatever condition they see fit, as someone else is already paying you “market value” :+1:
