Hello I need help about a insurance claim or damaged bike

I need help about my bike before some days I buy a motorbike for myself but unfortunately the seller sell me a insurance claim or damaged bike which I don’t know at that moment and he did not tell me about that after few days dvla send me a notification that this bike is insurance claim or damaged and I can’t use it on road and also they did not issue me a logbook they just send me an email that I’m the new keeper of the bike so I contact with the previous owner and tell him about the bike he refuse that I don’t know about the bike I didn’t make it insurance claim or damaged but finally he send me 400 pounds back
I bought that bike on 1000 pounds by bank transfer and when I call him for the rest of money he didn’t answer me and I’m stuck with this situation from 3 months please help me what should I do in this situation I need your support to take a good step against the bike previous owner

Oh man that sounds like you got screwed over.

I don’t know what you can do in these situations… Small claims court perhaps, if you bought from a dealer but this sounds like an ordinary guy which makes it less likely. Regardless, it will be difficult (or impossible) to prove one way on another as he can always say he said it.

Unfortunately it’s a little bit on you on not doing the HPI check (assuming you didn’t). If you did do one and the HPI check came clear, then you might have possible recourse against the checking agency?

Do you have copies of the advert / bike listing? If they’re still online, download them before they get changed / deleted.

In the advert, does it mention CAT A, B, S, N (or similar)? Being in the newbie section I don’t want to assume anything but you probably would have spotted that and known what it is.

Without wanting to be the harbinger of doom, I feel you might have learnt a very very expensive lesson… It’s happened to most of us in the past in one way or another.

As mentioned above, always worth doing a HPI check on any bike or car you’re buying. Even from a dealer.

Sounds like one for small claims court assuming you have the owners name and address. It’s really easy to do and it doesn’t cost very much to initiate the claim. You could speak to citizens advise either.

So initially you write a letter requesting the money in 14 days and advise if you do not receive it you’ll initiate a claim in the small claims court. Most people ignore this letter. From there you initiate the claim and it generally goes in one of three ways.

Most normal people (and normal businesses) just pay it when they receive the court summons.

Some dodgy people will write a response challenging the claim and you may end up going to court to have it resolved.

People who have no money, (and don’t care about their credit rating) don’t respond and are issued with a County Court Judgement, which they don’t pay. Then the county court Bailiffs go round and try to recover the costs but they don’t have much authority. Then you can get it escalated to the high court and get a high court writ. From there you can instruct high court sheriffs who have more authority but if there are no seizable assets (such as a car on the driveway) and the defendant doesn’t let them in, there isn’t much they can do. If the high court sheriffs cannot recover any costs you have to pay them something like £120 for their time. So the claim goes unpaid and the defendant just has to live with their County Court Judgement.

I know all this due to lessons I’ve learned over the years.

So it means that the claim is not gonna be work I know his name and also I know about his accommodation he live in the counsel accommodation and yesterday I just try to call him he send me a voice message that he can’t pay the rest of my amount but one thing I heard in his voice that he working as a uber delivery driver and he living in a counsel accommodation right now
I don’t know about hpi check that’s why what happened to me because of bike it was my first bike that I try to buy but it’s just like a headache to me now

Really sorry you’re in this shitty situation. I’ve been in a similar one with a dodgy ‘dealer’. It bit me hard in the arse at the time but now I chalk it down to experience (easy to say after 15 years have passed).

Others might know if these issues can be repaired at all but even if they can, economically it’s probably not worth it. Do you know what the issue / category is of the bike.

I don’t know the category of the bike but DVLA send me a notification about the bike that it was insurance claim or damaged and you can’t use it on road and they didn’t issue me a logbook I have just a new keeper slip and dvla send me an email that I’m the new keeper of that bike

It may be worth you doing an HPI check to find out what is recorded so you then know whether the bike can be repaired and put back on the road or is only allowed to be used for parts.

Coincidentally I went to see a car for sale last week. The vehicle itself looked sound, the V5, MoTs, service history file and receipts all checked out, but the trader himself gave me a bad vibe: he had given me a post code as the meeting place - a post code which was different to the one in his Autotrader ad. I walked away.

@Dada Sorry to hear you’ve been scammed. There are lot of scammers out there. Hopefully you’ll be on two wheels before too long, there are good dealers/traders out there too.

Yeah that was the lesson I learnt that day, never buy from ‘home dealers’ as typically they are buying shit cars (at auction etc) to sell for a profit after a quick beautification.

You pay a premium for a main dealer but reputable ones will not really dabble in crappy bikes (there’s always exceptions). The price will typically be higher.

Car / bike owners selling is really too much variation to have a concrete rule - approach each one with caution.

To be fair, never bought a bike from a dealer so don’t know how dodgy they can be. My experience with dealers is in cars…

Over the years I’ve bought two used bikes, one new bike, and two new scooters from dealers. Overall I’ve found them all to be reasonable to deal with and don’t feel I was stitched up.

Car dealers on the other hand! I have so many stories including: I bought an almost new Citroën from the main importer and concessionaire in Slough. It came with their so-called inspection plan. Yet the tyres were not even road-worthy, cracking with age and flat-spotted. I got them replaced under warranty and they even managed to screw that up, not putting the valve cores in securely and leaving me with two flats.

Your problem there is you bought a french car. Even buying from the factory it would have been as reliable as a chocolate tea pot

Indeed. After a lifetime of Italian car ownership - and suffering no problems despite the well-established opinions - I thought ‘how bad can Citroën be?’

Now I know.

I did not keep that car long.
