Although this should have been posted in Help & Advice section… has any of you out there ever claimed against Motor Insurers Bureau? I just want to know how it works in comparesment to claiming against the other party’s insurance?
Not entirely convinced I know what that is. Is it the fund used when an uninsured person needs to be claimed off?
So you can probably tell I can’t really help, soz.
Perhaps DanCBR600ridrer can be more help.
That is correct Andrew, thanks anyway.
I claimed agains the Motor Insurers Bureau when i was ran off the road in my works van, the other car never stoped and i ended up in hospital to cut a story short, it took 4 years and i gained a few quid from them.
Hope this helps you…
Yep, few years ago (in my car) had a car pull out on me who was uninsured.
Had legal cover so they processed and dealt with the claim, took a few months but I got my money (bit more than i thought the car was worth!)
I along with my solicitors are putting in a claim through them for the hit and run driver that had me off last year. I don’t know much about them but have heard on the grapevine that they usually work very slowly.
After a year and a half, my insurers decided to claim against MIB, as the owner of the car which hit me is ignoring all their letters(although she was not driving at the time, she has lent out her car to someone 3x over the alchohol limit).
I have also heard that they work really slow, but that does not bother me that much. What bothers me is that apparently, they take lots of money from your claim.
Not only that, but I feel that my insurers could have done more to find out if she was insured, rather than giving up that easily (I may be wrong)?
She’s ignoring your insurers’ letters? Your insurers should have appointed solicitors a long time ago and this should already have been dealth with by the courts! Sounds like your insurance company doesn’t care what happens.
Did she give her consent to the drunk driver to use her vehicle? If so her insurers should deal as RTA Insurers and then seek to recover from their insured and/or the drunk driver.
Your solicitors should have contacted the MIB as soon as they knew that the driver was driving without insurance. If it’s one thing the MIB are good at, it’s finding out the details of the matter, locating the relevant insurnace company and forcing insurance companies to pick up the tab.
Make sure your solicitors notified the MIB within the prescribed time limits otherwise you lose your right to claim. (that’s not to mean you can’t claim against your solicitors on the grounds of professional negligence )
The MIB shouldn’t take any moeny off yoru claim but your heads of claim are limited depending on what claim you’re making, i.e. if it’s a claim against an untraced driver or if it’s a claim against an uninsured driver. Make sure your solicitor has set out in full what you can and can’t claim and what the cost implications are.
Honestly, I wouldn’t try claiming anything from these guys, they look way too dodgy. Photoshop courtesy of Rottie.
I wouold like to say that I am an expert in claims, but an ex is a has been and a spurt nis squirting out under pressure. Can help with advise, but gotta warn ya MIB in horrible back log, but they do have rules for dealing with the claims.
Is yours an untraced / uninsured or green card application ?
If ya wanna PM me the details I will try and help.
