Had my first off today...

feeling very lucky as it could have been much much worse.

Overtaking a car which decided to turn right onto a very minor road (deadend) without so much as nanosecond between his indicator going on and his decision to pull across and out in front of me…evidently checking your mirrors is optional on a wednesday morning. Luckily I wasn’t going too fast (maybe 25) but no doubt part my fault too.

Leg is killing me - but given the fact that I finished up lieing in the middle of the oncoming traffic - could have been a whole load worse. Bike in the garage and awaiting the bill…

Qn then - given that I’m on the otherside of the raod overtaking (as I’m entitled to do) - surely he has to make sure it is safe before he changes sides and/or turns - he sort of did both together - as we were 20 yards short of the junction when he started his turn cutting across oncoming traffic.

Any thoughts?

50/50’s probably the best you can hope for. had the same accident myself. without witnesses it’s pretty much the going rate. they might try and offer you 70/30 (against you) but don’t have any of that

That’s kind of what I was thinking - which is annoying

firstly glad you are ok and the bike will be fixed

strictly speaking it is your fault as you were overtaking at a juction

If you have witnesses that he make little or no indication and made a sudden turn then you should get at least 50/50 but it will be a fight

Sorry to hear of this. If you haven’t been to A & E to get your leg checked out, you should do so now.

Overtaking at junctions is illegal but I guess it may be possible for you to argue it was their fault on the basis that you hadn’t yet reached the junction, and/or you and the car were going very slowly therefore you were “filtering” rather than “overtaking”. If you had a witness to back you up then that should help.

Either way you will now have learnt the lesson that filtering past or overtaking other vehicles at junctions is fairly foolhardy unless you are 100% sure they are not going to make a sudden turning like this one did.

Glad your ok, like you say though you were over-taking which in actual fact you are not aloud to do!

I would also say you were “progressing” not over taking same thing very different meanings.

I agree I think 50/50 is going to be the best bet here.

That was my first ever accident too mate (overtaking and getting twatted by right turning car) - happened a couple of months after passing my test - I managed to stay upright but the impact bent the gear lever and bruised my foot.Your accident could have been a lot worse but luckily it wasn’t. I’m sure this has sunk in by now but to reiterate - never overtake a cage/lorry if there is a rightside junction nearby - a lot of people don’t look or use indicators. :wink:
