hi, i just had an accident on my honda hornet 600, sum guy decided to do a u turn infront of me with out looking, and im just wondering what kind of personal injury compensation i could recieve, i hav two hairline fractures to my left hand and severly bruised testicles ( no joke it hurts like hell), just wondering what that is worth as this is my first on road injury that wasnt my own fault.

I feel yer pain on the smashed testicles … Thats gonna hurt for a few days … The pain is only part of it the constant feeling of wanting to throw up was the real annoyance .

Still going through the motions of liability and ridiculous quotes though…it all depends on the medical reports and what the doctors deem your pain and inconveniences to be worth it seems.

It is very difficult to put values on personal injury claims as no two claims are ever the same and much depends on a number of factors.

Liability (which does not sound like it will be an issue in your case)

Any loss of ammenity together with loss of earnings, loss of overtime etc.

How long you are incapcitated for.

If it is your dominant hand/arm that makes it worth more than if your non dominant.

There are other areas which are also taken into consideration.

The claim is divided into two sections.

General damages - This covers the actual injuries you sustained including a payment for painand suffering

Special damages - This covers all your additional losses, such as overtime, damaged property, parking charges, any transportation costs, anyone you may have to pay to do what you would normally do such as doing your garden or walking your dog, these can all be claimed for.

There is a book called the Judicial Services Review Board assessment of personal injury damages which is a guide often used as just that, a guide, and it contains every injury and is sectioned as minor, moderate and severe.

However, within the trade (so to speak) we use what is called the “Black Book” which has all damages for all like cases and is regarded as a more accurate guide coupled with awards to those cases which have gone to trial thereby allowing solicitors to make a more accurate judgement.

Just bear in mind that although you are in pain and you have 2 hairline fractures, your claim will not be worth a fortune, and your case will be run under the fast track scheme as it will be valued at under £10,000 so you will probably end up with a paralegal or legal exec dealing with your case on the portal system.

There a few law firms who will take on your case, but the numbers are decreasing because claims such as yours also tend to fall into the fixed fee scheme (about £1400 in fees in total) unless it is determined that your injuries are more severe or liability is disputed in which case it will be moved onto the multi track system where fees are not capped and your values will also increase.
