hi there guys, i need some advise because im totally srcrewed!!..
i was riding on the A40 towards central london, and no cars were infront of me so i thought opened the throttle a little, about 80-90 mph in a 50 mph limit. after coming off the A40, an unmarked police car stopped me with one police officer in the car, stepped out, and told me that i was doing 98 mph caught on the laser gun from 400 yards away and on the onboard camera, and that i will shortly be going to court. after trying to plea with him, he said that if i continue to talk, he would arrest me and take me to jail.
i already have 10 points on my licence, and i really dont know what to do, im fu*ked!!..
i really dont want to lose both licences, and cannot afford to as i work as a part-time bike courier.
Ouch!!! I’d definitely ask Citizens Advice if there is anything that can be done. Other than that, I can’t really suggest anything except, next time don’t stop!
Sorry to hear mate, you can try and get a letter from your employer stating that if you lose your licence it will affect your lively hood. But the 10 Points already may be an issue
Mate to be honest if you were doing 98, then what you should do is get yourself to court, with a good brief and a letter from your employer and offer to take some driver / rider training…
Your brief will know if the force / judge has a policy on this… This is going to cost you money either way, but might as well invest in good representation, and don’t forget to say sorry for the rush of blood to the head and that’s why you’d take some extra training… Your Honour
Ouch! Not good 666! Lee’s right, you need yourself a very good brief, someone with history of representing bikers. Perhaps speak to the BMF to get the number of a specialist, if someone else doesn’t post one up first. Whereabouts on the A40 was this?
Re Jay comment - I bet it was just after Northolt airfield where they have recently extended the 50 zone west by a mile or two. That also applies going west, instead of cresting the hill and nailing it, you have to hold at 50 until under the bridge before the airfield.
Everyone ignores it until the 3 lanes become two, or two become 3 going out of town, and it was only a matter of time before plod checked it out.
Really sorry 666, can’t think of anything to help. There could be a DD or CD charge thrown it to boot if they are in a really bad mood.
I remember some discussion years ago about the power’s of a single policeman on patrol, but it turned out it was all tosh.
Fingers crossed, follow the advice above, and remember that it’s winter and biking’s not much fun for the next 6 months anyway.
Right. firstly the system that the police use on the vehicle must be calibrated every time the driver changes, some are to lazy to do this so when you speak with your solicitor mention it .
What did the cop get you on ? the hand held lazer or the time/distance on board system?
Did he show you it on the screen in the vehicle?
If you read the MCN this week it shows that the handheld lazers are showing incorrect speeds when it is targeted on motorcycles. The home office stated that it would be ok to use these BUT! this was not disclosed to the home office or the traffic HQ!!!.
It was on the white city fly-over, i have absolutely no idea what to do, i’ve been depressed ever since, just waiting for the summons to come through the mail, somehow hoping it doesn’t.
what does DD, CD mean?
any idea how much solicitors cost? i really dont have the de’niro (£££).
I bet you the on board system was not working ! Mate speak with the motor defence team on Tel: 08704283456 @MDT they mite point you the right direction.
Sorry to hear about that 666! But if I had 10 points on license I would really mindly restrict my bike to the law limits… I will count badly against your case… Good luck
i remember some month’s ago a guy on his way to the ace on his newly bought 05 busa got clocked at 136mph!!! on the A40 as well by unmarked at hanger-lane all the way from hillingdon this was his second time caught speeding after being banned for a year the first time. they said they’d throw the book at him even harder for not taking on board the last offence.
it’s happened now 666, you need to look for a constructive way right now to get your mitigation up before the bench.
Really sorry to hear that bud… . A year ago it happened to me, wasn’t happy at all… But they were also tryin to get me for dangerous drivin!!! Do u know what they used to measure ur speed??? If its the Vascar thingy, (that doesn’t measure ur speed, measures there speed between 2 points)So u could use that to ur advantage!!! Have u done any drivin courses, If so get the certs out for ur salisitor. Anything that shows ur a good rider. Also any letters from work will help… Make sure that they say that if u “lose” ur licence u lose ur “job”!!! The courts don’t like makin people job less… And if possible go to crown court, should be better for u. As there is 12+15 people who make they decition, not 3 people like in a magestery court!!! But ask ur silisitor advice. If there’s anything else i can think off , ill write it down!!! OK. Keep ur chin up and keep smilin!!! I know its hard thou. My Fingers will be x.
He measured the speed on a lazer gun, from inside his vehicle. and apparentely caught the footage on the on-board camera, all from 400 yards behind.
does anyone know what i’ll get? even if its just a guess, a ban? disqualification? re-test? fine? or even better, “What’s the worst that could happen?”
I’d like to say thank you to all of you who replied to this post, i got some really contructive advice.
Althought i feel like sh*t, and haven’t had a good nights sleep in days, im going to citizens advice in the morning to try and get a better insight.
Jalfrazie has made a good point here about the validity of the laser system & whether the car’s onboard system was in fact working. You could simply plead not guilty. This will mean that the case will be adjurned until they get said copper into court. If they (plod) think their evidence won’t stand up, they might not take it any further. If however they think they have all the evidence they need, then the case will proceed and a good brief will be your best hope. The penalty might be slightly higher this way, but it’s probably worth a try.
666, take a look at this WWW.PEPIPOO.CO.UK and call a few legal companies. Most people have heard of White Dalton on 0800 783 6191, I’d also try Goodge Law on 0207 636 9222.
Pants man, thats rubbish : ( Hope it goes as well as it can.
Thats one of the reasons I brought a Supermoto. When I was on my Blade I used to ride everywhere at stupid speeds and todays bikes make speeding way to easy. My SMC makes 60 feel like a 100+ on my Blade and thats fine with me.
DD - Dangerous Driving - one back from Manslaughter. Ouch.
CD - Careless Driving (not as bad but is a ‘criminal conviction’ which SP’s aren’t, hence insurance companies get into a lather about them.)
My bro was caught at 102 in a car and was convicted of CD by the Scots courts. But that’s scots for you. May not (hope not) in your case. Solicitor said a ban of perhaps 6 months and a small fine. He got year ban, CD conviction, 6 points on his new licence, £900 fine inc costs, and had to re do his driving test. Much more than the brief said, so don’t trust’em entirely.
Whitecity flyover…? I have seen speed guns used on the stretch before the flyover - where the cars are parked on the roadside, but that’s a sod 'cause everyone nails it one their.
No help to you tho…
Advice looks good so far tho, but be careful before kicking a fuss on technicalities - pretty sure everyone caught must do it and the courts must know it. Pleading guilty and looking ashamed might be better. But then I’m spineless so…
Christ knows what I’d do in your boots man, so good luck and keep us posted.
