Hello all, yes, I boobed

Snapped by a new camera at Clapham North. I got the notification asking me to confirm who was riding and what the reported speed was yesterday.

I’m completely prepared to admit I was the one riding, HOWEVER, I refute the claim of 38 in a 30 zone. I KNOW I was only doing 32-33 at most.

What’s the situation regarding points for the alleged 38 in a 30, compared to 32-33 in a 30?

Am I going to receive a harsher penalty because of this and therefore…can I appeal? Would it do any good?

I admit I was over the limit, but definitely not by that much and if its going to hurt me with a heavier penalty , I just wondered what I could do and whether its worth appealing, or are those cameras numbers taken as written in stone and you just can’t argue with them…?

Any help please, but particularly from people who KNOW the score, not “just speculating”. Hence the thread title - Trojan, Darryl…any advice?

It’ll be 3 points regardless of it being 32-33 or 38 - usually a £60 fine on top of that. You could appeal but i dont think it’ll get you anywhere 7 will only end up costing you unless they actually are at fault and the camera wasnt calibrated etc etc but how do you get them to admit to that?

dont know if it applies to all, but 4 people i know have been done for doing 38 in a 30 and all 4 of them went on a one day course watching videos and talking about speed with no points, just a £60.00 fine. you can only go on this once within 4 years [ i think ]

if they dont send you on the course or should i say offer you the chance to go on the course and give you a fixed penalty of 3 points and a £60.00 then 32 or 38 is not going to make any difference.

this might be a wunch of bank, but what about that old 10% rule? Also if you think it was 33/32 that might even be 30 on a speedo, given the errors, ask to see the two pictures and see if you can extrapolate the number of lines/distance and see what that calculates your speed as…

I thought they have to give you photographic evidence.I would check your speedometer if you really thought you were doing 5mph less than they say, and if they can prove it. EDIT: I mean, check the calibration of the speedometer…I didn’t mean ‘keep looking at your clock’ sounding like a twat, lol…

also remember changing your sprockets to different teeth throws the speedo out, when i first got my bike it did over 200mph on a private road

If it was 32/33 you would’nt be prosecuted as ACPO guidelines are 10% plus 2mph.If you are adamant that you were’nt doing 38 ask for the photographic evidence,you are entitled to disclosure of evidence so you can have it examined.They are not foolproof as the one they showed in MCN last year showed.

the guidelines are just that - guidelines. not law. up north somewhere, durham or cumbria or somewhere similar they had a big clampdown a year or 2 ago and where issuing NIPs for one or 2 miles over.

Yopu can also request a copy of the latest calobration certificate from the speed camera.

IIRC they have to calobrated every 364 days of the year.
