Well, sorry but I work in construction H&S as a consultant and I’m afraid that the ruling was in line with todays law, and for a good reason.
I have investigated a case where an individual fell from 600mm from a stepladder and was killed coz his head hit a concrete floor.
Employers have an absolute responsibility to their employees to train and supervise them properly in matters which are likely to affect their livelihood. This is perfectly reasonable, I would like for the law to be weighted in my favour if I was hurt at work and could never work again, because that means the insurance companies will sort me and my family out in the event of me being permanently incapacitated due to an accident at work. The fact that his payments will be reduced by 25% because of his own liability is the Health and Safety at Work Act in process. Believe me its a good thing, I have seen too many people killed and families ruined due to accidents at work to think any different.
The law is clear in this regard for this reason and this reason alone. It may sound silly to the layman, but its a kick up the arse for the insurance companies and we all hate them dont we?
No-one should have to go to work and be killed for the sake of our bosses profit, and if they do someone must be held accountable for the death/serious injury. The law says its the employer, and the employer is legally obliged to insure against it. Its as simple as that.

I had a couple of office staff who wanted to shadow me on a job last week. I was pretty keen to go alone, fix the kit and sod off to the gym by lunchtime, and wasn’t pleased with the prospect of driving them back to our offices and then spending the rest of the day at my desk.
So I insisted they needed full IPE, and when they seemed keen to get that, said I couldn’t take them on the ship if they hadn’t had risk assesment training.
Result! 1205 HRS radar fixed, and I’m in the gym working on my pecs!
We are turning into the americans.

I agree with the gist of what you’re saying but this chap had signed a document stating that he had received step ladder training when he started the job and he also stated that because of the training he knew he shouldn’t stand on the top plate. But he did, despite his training, so in my book that’s tough sh*t.
How can we have people taking legal action over something that they agree they were trained not to do ? It’s a farce.
Listen, I had compulsory H&S step-ladder training nearly two years ago and had to sign off that I’d received it. The fact that I’m in a wheelchair apparently makes no difference whatsoever :crazy:
Nothing against the oldies working til they drop (!) but (a) surely this mature man would have had more sense then to stand on the top platform of the ladder and (b) would the injuries have been as severe had he been in his 30’s!

I bet even if this man had received “full” training he still would have done it. Human nature is lazy, ladder doesn’t reach, instead of going to get one that does, if I stand on the top tread I can just reach. I know I shouldn’t, I know I’ve been told not to, but it’ll be Ok If I’m carefull. Whoops.
Then everyone is paying higher premiums cos he didn’t listen or follow proceedures.
I blame the courts for hearing these cases, the tw4ts for taking it there in the first place and the judge for rulling as he did instead of throwing it out as a total waste of court time and money.
Shouldn’t have employed the silly old twat in the first place.
Hang 'im. In my work we have to have risk assessments for everything, including working in the office where we have to list potential risks which can result in papercuts, trip hazards from poorly fitted carpets etc. We are required to do this by H&S regulations. Ironically I’m a squaddie and have yet to see a risk assessment for handlig a weapon or going on Ops!!!

No they are not. We have SHEF reps and officers in every unit worldwide. All units must also display SHEF noticeboards. Don’t know where you got your info from but its wrong mate.
