Speeding outcomes?

Well, its finally happened to me. 94 in a 70, Camera van, on the A3 in Surrey (just south of the Ripley BP services, north of Guildford.

ACPO says that I am 2mph short of getting summonsed, so should be on a 3 points £60 FPN. BUT, ACPO is only guidance. Anyone know how rigidly Surrey stick to the ACPO guidance? Is it ‘thanks for the Christmas present sir’ or ‘Have a nice day out in front of the beak’? Anyone know?

And yes, I could go on about the perils of driving your car on a pretty clear straight road in good conditions, and how there’s just a kid waiting to jump out at you, in a way that is entirely consistent with a well looked after and supervised upbringing (if only we had a modern paedo that could teach us how to cross roads…) but that’s not really going to change the outcome, and I have heard somewhere that magistrates don’t really like the ‘shouldn’t they have been out catching burglars/stopping their officers shooting up their partners (Surrey appears to have a problem with that sort of thing) not sitting on the side of a dual carriageway’ line in mitigation… :wink:

Speed awarness course ? Or afternoon of boredom so great as to deter you from doing it again course as I like to call it .

Doubt I’d get a speed awareness course at 94. I was well aware of my speed. I’m just glad it wasn’t half a mile down the road.

Speed awareness if you can take the lecture from the self important twat delivering it without ending up with serious boredom damage is the way to go . The effects dont last long , I found going straight out and wringing the neck of the bike for 30 mins and a few wheelies cured me from it .

84mph is the maximum amount for a 70mph limit that takes into account your human & mechanical error, obviously its a percentage of the legal limit so the lower the speed limit the lower the margin of error!

Two of my mates opted for court sent the stuff back and never heard anything again infact one of said mates has done this twice, one for a red light jump & the other for speeding but he is a jammy ****, could fall in **** but land in roses…

You could try that or just admit i,t and take what they give you…

I thought the speed awareness course was pretty good. I only got done for 46 in a 40 though so hardly a credible effort. First step is to identify you as the driver and see what comes back in the post. Someone on here got 6 points for doing 110 as he pleaded guilty so saved everyone a lot of time and effort.

A word of warning about the speed awareness course, it’s your responsibility to follow it up. A friend of mine sent her stuff off and never heard back from them so missed the deadline and had to cop the points. Call them to chase it up if you don’t hear back promptly.

Plus at least you were under the magic 100.

speedometers are not always accurate, so they allow you to be a certain percentage over the relevant limit before they prosecute, i thought it was 10% + 2mph…

I’ve oft wondered, can you actually fail one of those speed awareness courses?

I don’t mean like in an exam sense, but if the lecturer decided that you weren’t taking it seriously or arguing/questioning a bit too vigorously the claims being made, could they do anything about it, eg. refer you back to plod to be prosecuted for the original offence.

I’ve known people caught doing ninety odd the coppers drop it to 84 saying that’s the threshold for court so you get the fixed penalty instead maybe it’s 82mph

I think Martin is correct, 10% + 2 mph, so the “limit” is technically 79mph: that, as in the original post, is purely ACPO guidance and not the law.

I think the threshold is whether you are more than 15mph above the speed limit; which means that the police could refer you to court, as their powers are not sufficient to punish you.

This would explain them dropping it to 84mph, and thus dealing with it through an FPN.

The 15mph is not in addition to the 9mph you get through the 10% + 2.

Go to court, give the judge a big cheesy and ask him if he’s still mates with Jimmy Saville. That should get you off :hehe:

I believe the only way you can fail is through not attending, so if you leave halfway though, or are so disruptive you are asked to leave then you will fail. A few of us on here have done one and thought it was actually pretty useful if you approach it with an open mind. Plus it’s much better than 3 points.

I believe the 10% +2 rule is not strictly law but a guidance factor… If I’m right I think it varies depending on the constabulary covering the area you are caught in.
