School Run Drivers :( :(

Well Today I’ve just had my first accident. :frowning:

4 days ago i bought myself a Honda cbr125, as i needed a bike to pass my test on it. It was in brilliant condition no Scratches lovely paintwork, nice exhaust, all working beautifully. And today i decided to go to the gym, it was a bit rainy weather but no too bad, but anyway i went down to the gym, had a good workout and i was on my way home, riding down the road, coming up to a crossroads near a school, there were some cars waiting either side to cross but no worry i keep going, i was half way across the crossroads and a woman with two kids in the back pulls straight out in-front of me, she pulled out so late that as i hit the brakes i was already in her side door and the bike was on the ground, i sort of managed to jump of the bike and hit her car with my arms i tried to stop myself from falling.

Anyway i get all details from the woman and she admits to not seeing me and saying that she should have looked again. I get the bike home and the woman’s husband gives me a call and asks what we are going to do, i tell him that we will have to go through the insurance and he then replies “oh, okay, so you’re gonna say that you were at fault”, and that really annoyed me, and through the whole conversation he was trying to blame me for what happened. He finished by saying that he is going to make a claim against me, i told him he has no chance.

But the bike front is completely smashed, the headlights gone, front fairing gone, brake leaver sheared off, front mudguard barely hanging on, exhaust scratched, mirror brocken and the clutch seems very weird as i tried to put it into neutral to move it away from the middle of the road. And as for me, i’m gonna have some pretty hefty bruising on my shins.

And now i’m just waiting for my insurance to call back as they are very busy

The worst thing is that i might not be able to do my practical test before the changes come in as ther centers are already very booked up, most until September, and now with my bike being unride-able i will probably not be able to do my test.

That really sucks fella, can you not hire one from the school you are learning at, or failing that borrow one from a mate?

I think i might have to, but that means that i will get less practice on it, than i would do normally.

does it look like it’ll get totaled? if so it’ll pay for your new bike and your test:D insurance should also pay for the hire bike from your learning place so no real loss of practice.

damn!, unlucky, but keep it going through insurance of course, & did you manage to take any witness details?.

I’m not too sure, the clutch seems weird, but i suppose it depends if the forks have been bent and it doesn’t seem blatently obvious that they have.

No unfortunately i didn’t think of that at the time, but there was a shop on the corner, they might of seen something, and there was quite a few primary school children around, but i’m not sure if they count :confused:

no i didn’t :frowning: , i didn’t think of that, and by the time i got her details everyone had gone.

head back to that shop and chase up anything you can.
even tomorrow, wait at where the accident took place, same time etc, & ask around - you just never really know.

I would make sure you report the phone concvrsation to your insurrance company in writing ASAP. It sounds like the other party may seek to make a false claim so tell them when the conversation took place and how they threatened to accuse you when they had already accepted blame. And get a witness, you can be sure they will have one to say you were at fault!

I will do, currently I’m waiting by the phone for the insurance company to call back, and when i’ve spoken to them i will go to the shop and ask around, and like you said, i will be there tommorrow around the same time and see if anybody saw anything.

Just for future reference, alway’s get as many witnesses as possible. Alway’s try to get pictures (mobile phone/camera) of the damage, position of both vehicles and different angles of the junction (including any road sign’s etc…). Never admit liability, and make sure you get all the details of the person involved. :wink:

I understand that your adrenaline was going and you were probably in a bit of shock, but try and remember these point’s for next time (trust me, there will be a next time! :stuck_out_tongue: ).

Good luck with the claim, and don’t let the husband worry you, the law, and damage, will prove that it was down to his wife’s bad driving and lack of observation. :wink:

Sorry to hear about this. For your test you might as well just hire a bike for it. I think this is what most people do- I did.

Sorry to hear that mate, i see school run mums always on the poxy phone and it makes my blood boil.

it makes me sick these bloody drivers need to be got rid of … chop the bloody kids legs off they don’t need then anyway , no wonder the kids are so fat

go to your doctor asap and complain and about any aches and pains you may have tomorrow , you may very well not feel then till then anyway , and publish the the addres of the driver on here and we can all tell them what we think …no not really :smiley:

First things first. Sorry to hear about the accident, that is a bummer. Secondly, always try to get a witness. It’s to late now but remember next time (hopefully there is no next time). Third, dont wait for your insurance company to call you, get on the phone and badger them. You pay them good money, make them work for it. Fourth, if the ladies husband calls you again remind him that when it comes to her insurer questioning her by phone a lot of insureres now use voice stress analysis and she will be caught out and there is a hefty price to pay for trying to screw insurers. Lastly, tell your insurers about this conversation ASAP (remember point three;))
