I recently had a road traffic accident when a car came out from a give way and hit me meaning that he didnt hit my bike but actually my leg and when I layed I fructured my right wrist (my good hand) rolling over with my head on the payment and my body on the road.
I ended up having a opperation on my leg with a plate and nails placed, wiplash which causes pressure on my chest, depression and a fructure bone between my wrist and thumb but going for another x-ray in another week to confirm the which bone.
The worse part of my bike of what i heard so far from a friend is the mirror (metal part) is missing and we cant find it, the clock is completely broken off that you can see the wiring and with the car well I only broke his licence plate with my leg
I only know one other person who has had a accident and it was nearly as recent as mine and not as seriously. Any idea if I wouldget much compensation?
it’s all done on a case by case basis, and also each insurance company will variey… I would have thought the damage repaired on the bike + a couple of grand and loss of earnings really
The main thing at this moment in time would be to concentrate on getting better yourself and making sure all the relevant insurance details are filled in correctly. Your insurers should give you all the necessary forms to fill in etc usually the main one for the vehicle damage, one for clothing and one for personal injury. If you are going for personal injury this will be the one that takes the longest to payout, quick cases take well over a year.

As has been said there are no set amounts allthough there will be rough values for level and type of injuries.I know on the last one I had,the final settlement was four times the first amount they offered,cheeky sods!!!

It sounds quite simple really, if he failed to give way and hit you while you were passing the junction it is 100 % his fault without dispute.
Were there witnesses to the accident?
If the other driver has admitted liability it should be very easy to resolve.
In my case I suffered a fractured right foot when a car pulled out on me in the west end, the total sum including a couple of weeks off work came to £4700 as a final settlement (which certainly surprised me - I was expecting far less.) I simply had my foot in plaster for two weeks, going by the treatment you have needed and endured I’d expect quite a lot more than this, you may be looking at 10k or more depending how long the accident related symptoms last and indeed mental stress, depression related to it (and if you needed a metal plate in your leg I’d say this will be substantial.)
Are you in contact with your insurance company and have they arranged a solicitor? They should keep you informed as to what is occurring, establishing liability etc; if not you should chase them up.
You could opt to use your legal expenses policy to pay for a firm like Rider Support Services to handle the case, in my experience they’re competent, keep you well informed and are more pro-active than a lot of insurance appointed solicitors would be.
Bear in mind however that progress is always slow with insurance claims, you may be looking at a year plus to reach a final settlement.
In the meantime make sure you have all the information from your insurance company and don’t be afraid to ask for details on their progress.
You should get compensation without any problem. Your insurance company may put you in touch with a solicitor to deal with it. I got over a grand in compensation (in addition to the cost of the bike, cost of helmet, new leathers etc) in 2007 when a car turned right in front of me. That was with an outcome of 50/50 liability, as it was only the driver’s word against mine.
So you should have no problem whatsoever - if your insurance company do their work.
Just got my comp from an accident, took two years from accident to payout so don’t hold your breath. Was no arguement over fault either, other driver had license taken away by DVLA (she was 72 yrs old and apparently couldn’t turn her neck, hense not seeing me when she decided to u turn).
Biggest payout will be personal injury but don’t forget to keep all your receipts for taxi’s etc, you can also claim mileage if someone has to give you a lift to Dr’s, hospital or to help you/visit you because of your injuries. I got four weeks worth of daily visits from my girlfriend (50 mile round trip) because I couldn’t walk unaided. A good solicitor will tell you exactly what to claim for including personal care.
I also claimed for and got everything I was wearing including scratched glasses.

The fact that your case took longer to resolve suggests that your case was valued properly. Often with many cases that are settled too quickly, the claimant can lose out by up to 50% of the real value of their claim.
There are two injury payments, one for the actual injury called general damages, and then one for pain and suffering as well as out of pocket expenses, loss of earnings and so on which is called special damages.
Each case is valued on its merits and values are laid down by the Judicial Services Review Board which have to be complied with by the courts, insurers and solicitors.
The independent medical examination is the important area as a long term prognosis will be reported and much of the settlement will be based on his/her report.
