question for our police officer folk

me and a mate was pulled over last weekend for riding like a complete twats (hands up) by a video cop car they made us watch the video (in which we did do a few risky things) and was told that insted of points will be giving an asbo type warning (in which we accepted) would mean that if we got caught again riding like it again within the next 3 months our bikes would be sizzed and get given points for the 1st offence and points for what ever offence in which was caught but we never got given any type of paperwork please dont get me wrong im not moaning far from it i just want to know where do i stand as ive not paperwork can any one help

not a copper but if they got your details, maybe they will just keep it on record or send you some paperwork in post?

i am sure the boys in blue will get to you soon, but in the mean time i was told that the result of your warning could result in you losing you bike as well if you get caught again.

I am not a traffic officer, but I think the following bits might help

Did they specify any offences that they were considering prosecuting you for?

Did they utter any sentences starting with the words “You will be reported for the question to be considered of prosecuting you for…”

If they were considering doing you for reckless, dangerous or inconsiderate driving they have to use an exact phrase, called the warning formula, if they don’t do that they have 14 days from the date of the offence to serve a form called a Notice of Intended Prosecution. If they don’t do either they cannot proceed with those offences. They also need to do that for speeding, red lights, contravening traffic signs, and leaving your vehicle in a dangerous position. The only exception is where the offence has come to light due to a collision.

If they haven’t done that I’m pretty sure they can’t bring the prosecution 3 months down the line…A rat might know differently though…

As for regards to the anti-social use of the vehicle, so long as they have warned you, it’s enough, your details and your vehicles details will be recorded and if someone were to catch you using your motor vehicle in such as was that it “is causing, or is likely to cause, alarm, distress or annoyance to members of the public” you may have your vehicle seized and disposed of or crushed.
