PCN for bus lane infraction

I agree with RR…not like a car when they can get a still shot of you in the bus lane with your plate.

I would have looked for any side roads nearby and say I came out of that as another bike went in…:wink:

From about 0.05 to 0.09 you appear to me to have had space to move back out of the bus lane and into the main lane, having gone round the car that appears to be turning right. However, you continued down the bus lane for a bit, albeit only a fraction inside it. I think that this is where there getting you, not where the arrows etc come into play as you approach the junction, because by that point you come back into the main lane more or less and they’re just following you to get your plate.

That said, I’d make them work for it too. Good luck.

I usually see the £60 as a worthwhile payoff just to make it go away quicker and not get bogged down with it…but fair play for your effort…hope it goes well!

I also would fight it, Jesus apart from the car turning right which you avoided rightly you was actually in/on the bus lane for 2 secs:w00t: you then entered an area that was a junction and after that when the camera tries to follow you past you never touched the bus lane so as i see it i would argue the toss and make them work for their bloody money.

That’s complete c0ck - what about discretion? You were slightly in the bus lane - so f*cking what - you weren’t holding up a bus up or getting in it’s way - if you were - then they would be right to fine you - why can’t they use common sense and discretion? It’s difficult enough making a living and getting around London as it is - without this surveillance state sh1te we have to deal with.Why don’t they try looking for bike thieves with these cameras - watch out for their vans and then alert the police - do they do that? Do they f@ck - because there’s no money in it for them.If someone can contradict me on that then i’ll be pleasantly suprised and take it back - but our bikes are getting nicked right left and centre in a city stuffed full of surveillance cameras and the thieving scum seem to be getting away with it with impunity.So we get turned over twice - once by the council - then by the thieves. . . :blink:

Fortunately the councils don’t have the power to fine people for entering a cycle box - only the police can do that, but things might change.

As for your positioning - being a bit in a bus lane is like being a bit pregnant - and you were asking to be taken out by a pedestrian crossing in front of a van, or a vehicle you were passing pulling to the kerb etc.

If you are going in a bus lane, whether legally or illegally, you want maximum visibility for you and the vehicles you are passing, and maximum time to react to anything going on - so keep well over. The same goes for filtering on the other side of the queue.

Entering a cycle box isn’t illegal - if you can’t safely stop at the first white line you’re allowed to carry on to the next one.

I think all the above posts stating you were in the bus lane so its fair cop are missing the point.

Whether you’re guilty or not is irrelevant in our legal system. Murderers caught with the gun still smoking can get off with the right defense and loopholes. Doesn’t make it right, but thats the system. Play the system and sometimes you can win.

Yes you’re caught on video the wrong side of the white line. This isn’t in dispute.

If the bus lane signage is invalid then the bus lane is not legal and a PCN cannot (or should not) be enforced.

I’d like to ask all above who said to just swallow it a question.
If you were riding at 40 on a road with signage stating it was a 40mph zone and got pulled over by the police to be told it was really a 30 mph zone but the sign was incorrect and so therefore had a fine, how would you feel?

There are strict guidelines for road layout, if the road or signage is incorrect then it should not be enforced.
It should also comply with the traffic order that was made to install the bus lane.

I think you should go for it. As I said above though, the councils usually throw out the first infomral appeals anyway hoping the threat of £120 will scare people to cough up. If the signage really is incorrect you have a good chance of getting it thrown out by the independent bus lane adjudicator. However to take it that far you have to risk paying the £120 if you lose.

Not a great example. The rider knew he was in the wrong and so didn’t go all the way into the bus lane. It’s a fair cop when he was caught partly in it. Fact is he could have been filtering down the outside (after the car had turned) and took more of a risk going up the inside.

I got 2 tickets from Camden in two days, it’s just an exercise in making money. I managed to get off paying one of them.

You may as well appeal, BUT make sure it’s for the fact that the buslane is incorrectly marked, or the wrong width etc. It’s worth appealing online as it’s very flaky process and if they say you didn’t appeal when you did you can usually get the PCN thrown out.

If you appeal that you were causing no harm, were only in the lane for a few moments and avoiding the other car then they will just throw it out.

They will probably throw it out anyway but you then have to decide if you want to go for the full appeal. There’s a good chance Camden will back down at that stage, but you have to be prepared to risk the extra £60 fine. You really need to have proper grounds for appeal at this stage because on the video evidence you will be fined.

I’ve tried Peepito for advice, but there are some real ‘wnkrs’ on there who just want to try and prove how clever they are and will make sweeping statements without really helping you win your case.

Don’t hold out too much for the avoiding the car turning right - a friend of mine was prosecuted for moving into a bus lane to let an ambulance through! Can you believe that? I just hope that the bstrd that nicked her is in need of an ambulance one day, and that said ambulance gets stuck in traffic…

Was listening to LBC a while ago where someone called in about moving into a bus lane to let a cop car through and got a ticket, which was contested and lost. Since then I dont move out of the way if I have to go into a bus lane - let the emergency vehicle use the bus lane…

It is very sad but becuase of incidents like this I now no longer move through red lights or into bus lanes to allow emergency vehicles through.
