Some of you may remember a few months ago I got a parking ticket because my ticket had fallen off the window, well after the 1st appealing failing, I’m pleased to say this morning got a letter from the council saying they are happy with the evidence and have dropped the charge.
So not only is it a sunny day, added to the fact I’m in central london (I love it here) I got off the parking ticket.
I would like to make a special thankyou to Bumble Bee who without talking to him I probably would have cracked and paid the fine.
So it will take alot today to wipe the smile off of my face…
How long did it take in all? Im waiting result of my appeal too? Last month i went to an underground car park, that i usually use when shopping…went to get a ticket and the machine didnt work, now i only use the bottom parking cos the place is dark and dingy and i dont even know about the ticket machines or if there is one, on the 2 other levels, and wont go up there alone…kids hang around in there and all sorts…people peeing up the walls, etc etc…you get the picture im sure.Anyway, i hung about to see if i could find someone, of course no one there,so then i left a piece of paper, the only bit i could find, with the time and said the machine was broken…when i came back an hour later, i had a ticket, given by the way about 8 mins before i got to the car? so i went looking AGAIN for someone…and again couldnt find anyone…went looking to see if they were in some part of the building although i hate walking round that car park…then called the council, told them what had happened and that i use that car park all the time and always pay…they said to email the office and let them know what happened and that they will also email to say i had rang them…Got an email that week saying they had my email and was looking into it and that the ticket has been upheld until they sort it out and they will let me know…and im still waiting?..how long do i wait before i just give up?..as i said this was beginning of April, over a month ago? Good for you by the way…see i would have paid too, but i didnt see what i did wrong considering i left a note as well…and it wasnt my fault the machine wasnt working…yeh they could say i should have gone on the other levels to look for another machine, but i told them the state of the place, how dark it is, and who hangs around in there, and that i wasnt happy walking all around the place to look…i dont even go on the other levels…they have pee and flooding from the pipes pouring out, kids running about, playing loud music etc…so no…im not having to get into a fight or whatever with someone cos they want to nick my bag or purse while i buy my ticket on my own…thing is, im not scared of the fight bit, but you hit a kid nowdays and its YOU that gets put away for something THEY started !!! either that or they are that high you get knifed…what a world eh?
this happened to me on the 1st of feb so about 2 months in total, but like I say I had to go to the second appeal before they listened.
With yours it is completely different grounds, the ticket warden should have reported the machine was broken so they should have a record.
Also he should have taken a picture ask for a copy of these, it will show one of 2 things, either he did not take any or that you had left the note that way this will help cover your back.
Good luck with this though, just so you know somthing similar happened to a friend and they still had to pay the ticket, but this was becaus no one had noted it was damaged
Believe me I thought the same, but thanks to Bumble Bee who gave me some realy knowlegable information I kept going and boy am I glad I did now.It would seem that the 1st letter is basically automated and they will send it anyway thats when I was thinking of paying… But I knew I was in the right and glad to see some common sense was employed on this one.
I had the same thing in Tower Hamlets recently. My permit had come unstuck from the window and dropped onto the floor, face up ( although I didn’t say this ) . I emailed them with a copy of the permit and they said they would put it on hold for 7 days. After 2 weeks I emailed them again for an update and was told they had already sent notice to say it was cancelled.
I have appealed tickets before with TH with some success. I would always appeal, but never risk a 50/50 chance of getting caught, like parking on a yellow line just cos others have.
Good for you anyway, parking fines as so disproportinate to the offence it is a disgrace
similar scenario happened to me in Westminster a few years back
they had no evidence of giving me a ticket and i took exception to the potential fine increasing if you appeal, completely unfair and probably illegal if pushed by someone with the means through to the euro courts
they dropped the ticket after a few choice words from me and a couple of months waiting

Well done mate in sticking to your guns!! i had the unfortunate task last year of fighting 8 parking offences on a bike i had sold on. Proving that i didnt own the bike anymore was the hardest part. I fought it all the way and won!! hehe so it does go to show fight these damn wardens, just dont pay it!
