5mins away from home a guy in a truck pulls out form stationary infront of me. (he later accepted blame and said he thought i would swarve around him)
i didnt swarve i braked hard, the front locked and went down.
i face planted (right chin) and slid facedown a bit. with the bike sliding beside me. apparently there was a huge smacking sound and sparks.
the bike being a naked and having sliders only has small marks on lever,bar end, foot brake and little scuffing on lower enginecasing. nothing else (i rode it home!
i waited for ambulance was checked out - only right thumb aching alot and right pinky abit. ended up going to a&e just to be sure and check scalfoids. in the end only have a broken pinky and straighed thumb,and a bruise on him where my keys where!
very lucky!
as mentioned the guy has accepted fault at the scene and wants to help out. but there isnt much to claim for. i even think the helmet is ok. i did hit the right chin area (now scuffed) but there is no padding there. so no need to replace right?
i could ask him for cash for the barend and level and a new visor.
ps sucks i was wearing a new arai but at least it fited perfectly!
Same thing happened to me slamming on the anchors when someone u-turned in front of me down the A316 a few years back - me and the hornet ended up doing the face down luge down the centre of the dual carriageway in rush hour traffic!

Agree with Ang and just ask for replacements on only what is damaged.
It was an accident and not like he wanted to kill you. At least he hung about and accepted his error and didn’t did off and leave you on the floor.
Be careful. As wastage case in my recent off, the driver admitted full liability on scene as he thought the damage was minimal. Then when I got my repair quote from Kawasaki and added the cost of a new arai and told the driver the cost, he suddenly decided to change his story, refused to talk to his insurers, gave me a load of grief etc
I’d ensure that he pays for everything right and necessary to put you/your kit/bike back to the condition prior to the accident. Might only be scuffs and scratches but you work hard to buy things in good condition and they’re now damaged and worth far less due to his actions, that needs to be covered. Would you buy that Arai in that condition? Would you pay the same as you did for your bike if it had that damage when you bought it? Probably not.
The personal injury is different, will it prevent you working and earning? If so someone needs to reimburse you for lost earnings. Compensation for injury is very subjective, depends on your morals I guess.
I’m not suggesting for a moment you take him for all you can - just that you are fair and seek to cover your costs caused by his error.
It was ‘just an accident’ but he shouldn’t pull out assuming you’ll swerve around him, WTF? worse still as a truck driver is supposed to be a professional driver!
Good that he did stop and admit liability - shows some testicular fortitude on his part!
Thanks guys.yeah don’t want to claim if not needed.BTW he does now claim I hit him.which I can’t believe as there would be more damage to the bike.also bike fell on right side away from him
yeah he says he’d rather go through insurance as well. he said he couldnt see the danage in the dark. when i talk to him i need to see if he just wants his insurance to pay for his damage.

I would go and seek advice from a solicitor that specialises in motorcycle accidents on a “non fault” basis. Once you give them the complete story they will be best placed to give you advice in which way to proceed. Don’t use your own insurance company as there are too many of them in “bed together” these days and only have their own interests at heart. You will probably have to advise your insurance company but stress to them you are not making a claim with them. good luck with whatever you decide .
Even if they want to keep it out of insurance, I wouldn’t because mine changed her mind, but thankfully didn’t change her sorry. I claimed for the bike to be put back to how it was, Draggin Jeans, and Boots, and the excess.
Yep even if it isn’t your fault you have to pay the excess and claim back. Unless your insurance company is very good.
I’m thinking of not claiming as I didn’t really hot him, he could say that I lost control and it probably go 50/50 meaning I pay excess what the rep repears would cost.
Only be worth it if I went full hall fixing bike, helmet for personal injury etc
