I am not trying to defend what has gone on here as I know far too little about the people and circumstances involved to have a valid opinion, but it might be helpful to understand what happens in a case like this.The issue of day release arises mainly because he wasn’t convicted of murder (which requires a concious act). He was convicted of manslaughter by reason of deminished responsibility. This doesn’t mean he wasn’t fit to stand trial, he has been tried. What it means is that the law does not consider him guilty of murder in that he was not in a rational state of mind at the time of the offence. The court’s verdict means that he is to be detained in a mental hospital until such time a a mental health tribunal (a judge, a psychiatrist and a lay person, all unconnected with the case) consider he is safe to return to society as a free person. This of course may never happen in which case he could be in a mental institution far longer than he would serve in prison if he got a life sentence for murder.

Whilst he is in the mental hospital he is treated for his condition, part of that may involve trips out of the hospital, but he would always be escorted by people with the powers and muscles to restrain him if necessary (having competed at tug-o-war with a team of psychiatric nurses and I would not want to get in a fight with them!) The mental health tribunal would expect to see evidence that this person was able to act normally and rationally in public and was in no way a danger to other people. That process which almost certainly will take years and years if he gets out at all.

WTF??? what planet you on?? bloody “do gooders” full of sh*tHe should be locked up and the key thrown away or locked in a room with sleeper and a few of his mates, thats the only justice scum like that should get!

Our justice system is a complete and utter farce !!! Time after time the old farts that make decisions and all these “human bluddy rights” people, let these mental (or so called “mental” ) a-holes out of prison on day release, and WE end up paying for their little trips here and there anyway !!, and some then go on to attack innocent OTHER by standers, injuring and sometimes killing them, while on them too !!! So yeh, eff off with that kind of talk, when they get sentenced (and its always too lenient anyway) then they should serve it right to the end, none of this “let out for good behaviour” shite !!! Not when they have just killed someone for gods sake !!

Signed, but busa_55, I think you may owe Giuliano an apology - he doesn’t say anywhere that he’s agreeing with it, just explaining how the system ‘works’ and how it’s possible that this sh1tbag could get out so early - at least on supervised day release. Violent crimminal who would probly commit a similar offence again

He has convictions for common assault on a police officer and inflicting actual bodily harm after attacking a woman with a key.

McLeish also has a conviction for a public order offence, where he threatened a man with a fork in a pub.
