Can anyone help at all with this. I’m so Pi**ed off with this that I’m considering taking two days off and paying a visit to AXA and Carole Nash head offices. I’m also thinking of contacting the FSO and CAB.
As you probably know, Serena’s R6 was stolen on the 12th Jan. We notified Carole Nash immediately and got a claim form sent out and notified the police at the local station, although there was nothing they could do.
After various issues, phone interviews etc. the situation has come to a sticking point. Because Serena was still paying me for the bike, we kept the V5 in my name (this was a temporary measure until she had finished paying) and AXA insurance are saying that they can’t pay out. They said that a letter from me explaining the situation and stating that I had no insured interest in the bike would do, so I sent one, but they have now rejected that. They have sent the V5 back saying that it needs to be changed to Serena’s name, but we’ve contacted the DVLA 3 times now, who say that because the vehicle is registered stolen they can’t do that and will pass the request to the police to investigate.
I was going to call AXA today to discuss options, but Serena phoned Carole Nash just now and Carole Nash have said that AXA are in the right and won’t pay out, they have also said that because the same situation exists with Serena borrowing and using Brooke’s bandit, they are cancelling her new policy as well, leaving her without insurance.
I can’t believe that it’s not possible to insure yourself on someone else’s bike. People must do it all the time, and in much more shady circumstances than ours! I remember being asked on insurance forms if I am the owner of the vehicle I am insuring and Serena would definitely have said no to the question if it was asked.
Please, can anybody help. We’re getting desperate, and Serena is beginning to lose all hope of ever getting another bike again.
I don’t suppose either of you is a member of BMF? In any case, might be worth your while calling the Biker Legal Line 08000-856 243 to see what the legal position would be. Also, dig out Serena’s policy document, as this should state if the bike was owned by her or not, in which case AXA will find it hard to explain why they could accept her premium but not make a payment.
Hadn’t thought about the BMF. I’ll see if I can’t get their help. I’m going to have a good read through her policy documents tomorrow morning. We’re going to a DVLA office tommorow as well to see if we can’t clear up the problem in person, with ID present, as I’ve had a chat with the handler at AXA and she is adamant that the DVLA have done it before.
the whole situation just sounds bizarre to me. For example, if it’s not possible to insure yourself on someone else’s bike, how is it possible to add a mate’s bike onto your policy on the ebike site’s pay as you go scheme?
so sorry to hear about the r6. there’s me telling you about my problem! although i had the same kind of thing. i insured the 750 for theft only as i wasn’t riding it, the bikes in my name finance the lot! however mce are saying they’re not going to pay out because it was taken by someone known to me and that because i dont have the keys as he took them with him that they are not going to pay!
its currently being sorted out through solicitor but i dont think they will pay!
get some legal advice, though you’re pretty smart, reading through the policy should give you some indication as to whether you’ve got a case. hope you’re both well and tell serena chin up from me.
proof of ownership is a bill of sale, it should be the log book but unfortunatley it does state that the v5 is a registered keeper document and not proof of ownership!
