MIB Insurance claim

Hi, has anyone had to claim via the MIB - if so how did you find their offer - generally less then if you claimed via an insurance company? Reason is i had to claim and have been offered considerably less then i would have expected. Any advice is greatly appreciated. Thanks

Yes a few years back, hit and run.

As there is no one to “sue” there is a limited pot, and normally the awards are set by portion of blame and precedent set by previous claims. Normally you would be represented by a solicitor. I wasnt happy with my first offer, fought more, and got more.

All depends on the accident, injury sustained etc… etc…

The best thing you need to do is to research what your accident was, i.e. whether it was a Road Traffic Accident or a tripping or slipping matter or an employers liability matter and then see from the JSB Guidelines or Kemp & Kemp, what amount your claim is worth in comparison to the injuries you received. Generally Defendant Solicitors and insurance companies use the JSB guidelines. You will be able to argue if they have made you an offer less than what is in the bracket for that type of injury. Also don’t forget if you have made any out of pocket expenditure such as prescriptions, or travel to and from hospital or someone has been looking after you whilst you have been off you can claim these back. These are known as your Special Damages. Your basic injury is known as General Damages.

I also pursue claims for a living, the MIB are not overly generous and thier claims are in a huge back log. You may have legal re-dress depends if your claim is under the untraced or uninsured scheme.

The MIB will pay in full for things like helmets but will try and reduce claims for replacment clothing siting betterment. All payments are made subject to a £300 excess for porperty damage, do you not have a legal expense firm assisting you with this claim ? if so, they should be assisting you with this. ]

Were you denied the use of the vehicle following the accident ? If so ask for compensationf ro loss of use and inconvinience.

All insurance companies will pay out the “MARKET” value of your bike, not what you thik or told them its worth!! Basically they phone 3-4 dealerships and take the average price (although this doesn’t include any extras) its crap!
