just been done for speeding

i was just on me way bk from the bank an got pulled by two policemen standing by the side of the road

the charged me for excessive speed but i`d just come off a set of traffic lights

i dont see how i could av been doing more than 30mph and i dont see how they can prove it

should i grin an bare it or should i fight it in the courts???

Like others asked, how did they record your speed?

if they have no means with which to measure and they did not tell you how they measured your speed you aint got anything to worry about. they were likely just stopping you to check your bike and ‘excessive speed’ was their excuse…infact those very words make me sure that they had no means of measuirng your speed as it is their duty to tell you of the recorded speed…

What did they record your speed on,where they on foot or in a car?Did they issue you with a endorsable fixed penaly notice or tell you that you would be reported?

they gave me a fixed penelty fine which is endorsable with 3 points offence code130

these are the kinds of police officers that give other Police officers a bad name…they are biased, prejudiced and ignorant…sadly like a lot of them out there.

Our government does not help by always painting this picture of speed being the killer and bikes always speed dont they…we cant win that one although even they now admit speed is not the cause and they and the police have been barking at the wrong door for years…but I am going to get on my soap box next so i had better stop now…

In which case you need to challenge it and request a court hearing and get a solicitor who knows what he’s talking about. I would guess they are not traffic patrol ,as they would have a laser gun.They are relying on you paying up without challenging it.Estimating speed from the roadside is very poor evidence.If you’re in a car following you could say that the speed was in excess of a certain speed .What is the shoulder number on the ticket?

Take it to court and fight it. As they have no evidence with regards to your speed, there is no case. Any right minded CPS prosecutor will see this and the case will be dismissed on the basis of no evidence.

There is no way on earth anyone could predict what speed you was going unless they have the tools to do so.

Don’t worry. No evidence = No case.

Unless they have a recorded speed, they’ve got no chance unless they were following you in a police vehicle with a calibrated speedo. They can’t prosecute someone because in their opinion you were speeding, unless you were going at a speed very, very obviously over the limit and even then they’d have massive difficulty making it stick in court.

I got pulled today too, but got off thank god. Was pissed off after trying to get from Hyde Park Corner to Thames Street when all the roads had been closed and cracked it open coming round the Aldwych. Next thing, blues and twos and bike cop in the mirror. Pulled over straight away and in fairness to him, he was decent, gave me a quick bollocking, told me to slow down and he was on his way. Didn’t even bother getting off his bike so hats off to him, thats sensible policing in my book. Things like this make me gain respect for the cops when they show a bit of discretion, a bollocking is better than 3 points in my book.

from what I understand they can issue you without having to record your speed as their testimony is evidence. If you take it to court and fight it then a good barrister can probably get you off but this is going to cost you. A lot more then if you just swallow it and cough up. It is also going to cost the CPS and the tax payer, so all round it is a waste of time and money.

You probably won’t even need a solicitor on this one. Had they done you for dangerous driving or anti-social behaviour it would be a different matter, but as they had no means of verifying your speed they were in no position to determine whether it was excessive or not. Put that in a letter to them and demand the ticket be dropped. They may write back saying that the ticket stands and they will give you the opportunity to pay it at the “reduced” amount - they may try to threaten you with an increased penalty amount. Write back again re-stating the facts in the first letter and demand the ticket be dropped. I would be very surprised if they didn’t drop it. If it went to court you will win.

It’s all perfectly legal - if you have 2 coppers who are witness to what they believe is someone breaking the speed limit then it’s acceptable in court as evidence of speeding.

Think about it a moment - do you think that no-one ever got done for speeding before radar was invented ?

He can of course decline to accept the fixed penalty & take it to a court hearing & try to discredit the witnesses ability to discern if he was over the limit or not, but in reality that’s gonna be expensive with a pretty limited chance of success.

pat wow, that is a revelation…and I had forgotten about that, its been years since i heard of someone trying that one and you are of course very right…I however did take them to court and did discredit them, thats was 30 years ago, because they rarely remember the details and it was the detail that they were supposed to be doing me for…ie speeding…and they couldnt tell how far away I was let alone the speed…so you can defend it, and our man thinks he was not speeding so its one for the lawyers…it has to be a close call, I say too close for them to be able to judge it correctly…
