Help I got caught at 122mph

Right this is the first time I have ever been stopped for speeding all on video etc.

I am now crapping myself I am normally well behaved when riding but today I saw red mist and was a man on a mission to get home after work, I got a producer but nothing else they said the tape would be going to thier boss for him to review the offence.

Am I in it over my head

You need a good Lawyer/Brief. Don’t put your hands up and say ‘its a fair cop’ you might as well bend over and let them shaft you because at that speed they will. Type ‘Speeding Fines’ into Google and a few pop up.

I hate to tell you this but expect a ban of some sorts.

Good luck with that, and as the others have said, time for a good breif… On a (slightly) postive note, I know someone who was caught at a similar rate of knots in a van and they got a 2 week ban…

Very good chance of a ban DJ. As most have said, get a good brief. It sounds impossible to wriggle out of this one as its all on tape. Ask for a copy so you can review it, it may not look too bad. Was it dry and sunny etc was it just a few seconds of sillyness as there was no other traffic on the road, this makes you much less wreckless and is all good mitigation. Itll help a lot if you`ve got a clean licence, be apologetic, wear a suit and if you can put a good case for how much you need your licence you may well get of lightly and if the ban is very short expect the fine to be big.

You say 122 but not what the limit on the road was?

I assume it was the Motorway?

Either way , to be honest, you have to accept the fact your going to get a ban and hopefully anything else will be a bonus…

I know it’s easy to get carried away in circumstances like you’ve described ,we’ve all done it (and anyone who say’s they haven’t is clearly lying!!)

But even if you were in a 70 your looking at 52mph over the speed limit and magistrates don’t like that at all…

Get a solicitor if you wish, most will give you the first half hour free, but if your on video, clearly at that speed , with no real defence, i think your going to find that most solicitors are going to get you to do a ‘damage limitation’ exercise and plead ‘guilty’.

The courts do lessen the punishment if you are seen not to waste time and plead early, you may also wish to get some character statements that DO help in court, especially from your boss who can highlight the difficulty you would have in work if a lengthy loss of licence was to be incurred.

If you know someone in law enforcement you could also ask them for a character reference as well or anyone else who holds a position within society that the magistrates would relate to…

It’s your call though…be wary of going in all guns blazing screaming ‘Not guilty’ etc etc…

At the end of the day you have to ask yourself, “Am i guilty?”

When you answer that and go see a solicitor it will become clearer.

my mate was caught speeding in his scooby 120+ but averaged him over a set distance at 116mph this went to court with no solicitor just owned up was remorsefull, which earnt him £300 fine five week ban and the best bit NO POINTS!!!

Get a brief if they send you a summons.

What was the speed limit?

Ask for the complete unedited uncut tape. The Police tend to be very reluctant to hand this over but it can be very important and a full copy should be in your summons bundle. When it isn’t apply for it in writing. When they don’t supply it ask for it in court along with an adjournment for a specialist to look over it. When they tell you the DPA applies to the tape tell them ********. DPA doesn’t apply to crown evidence.

I got done for 120 on the M1 about 6 years ago on my way to a trackday at Donington.

Called a few legal help lines (MAG, RAC etc.) all reckoned I was deffo looking @ 3 month ban & a hefty fine, search of the web revealed 1 similar case - Naseem Khan’s brother 120 in a BMW got him 3 months earlier in the year.

Got a brief, went through all the mitigating stuff - early Saturday morning, bright dry day, little traffic etc. plus I had a letter from my employers saying they’d have to review my employment status in the event of a long ban, went trough my social stuff - elderly parents etc.

Brief stood up & did all the presenting & basically exagerated/lied through his teeth, he ladled it on so thick that I was struggling to keep a straight face in the dock.

End result, 2 week ban, £540 fine + £35 costs, brief cost £300

That said, I calculated that by the time I added in the extra insurance costs (bikes + car) over the next few years, that pull cost me £3,000-£3,500 ! in total

I got done at southend doing 82 in a 40…got £280 fine and 6 points…i was lucky over double the speed limit? (very lucky)

Get a copy of the tape. Slap it on Youtubes or summit. Go to court and claim its circulation has harmed your defence!

No really, Get a copy of the tape. CPS might go for Dangerous Driving too, so at least you’ll know what they’ve got

There is never a ‘reluctance’ to hand over a tape.

TWO tapes are attached to the prosecution papers, one for prosecution and one for the defence (this is disclosure after all and a legal requirement!!) and the offence will be of speeding.

speed in itself does not constitute careless/dangerous, it has to be a culmination of events to warrant those offences , not speed alone.

Back to the subject of the tape, ‘unedited’ is a little confusing, NO tape in this world would be admissable in court if it was spliced and diced, unless your referring to ‘working copies’ which will be a copy of the master tape with only the offence copied…unless you want to sit through 8 hours of a shift!!!

the original master tape is bagged and place in a tamper-proof sealed bag and may be opened only in the presence of the accused or his/her legal representation.

‘Working copies’ also have to be agreed by both defence & counsel before submitted for view.

But basically they normally start a few minutes before and after the offence in question.

I’d rather have a 7 - 14 day ban than a year or so inside for attempting to pervert the course of justice…

Their might be a few technical fautls with this, one of them looked me in the face and said very slowly and made a huge point, “are you with rac or AA seek advice” after looking at my producer I have noticed that they have put the wrong DOB by 8 years.

i got caught doing 108 mph on a 40mph limit, got a 3 month ban, but no points, and had to pay £200.

just for an example.

if the limit was 70, i think you’ll get off with a month’s ban, if you look remorseful, and start crying in the court room.

Wow sympathies - we’ve all done it - the odd blap and suddenly we’re well over a ton.

Mind you the only way my current bike would reach 122 would be to drop it from a Chinook…

it’s down to how the magistrate feels on the day.

You broke the law, be apologetic, be prepared to accept any punishment, tell then this and leniency is more likely.
