Examworks investigation

It is normal for MIB to ask to interview claimants especially on cases where the offending driver cannot be contacted. If you are represented by a solicitor the company coming to see you should be contacting them first but generally they just say go ahead.

Maybe it is just normal for London then.

Certainly does not apply in most other parts of the country, but you are right that the first contact should have been made via the Solicitors, and most will question the need to interview the claimant because of the risk of said claimant saying something that is said in all honesty and then taken out of context and used against the claimant,  I have seen that happen many times, and in any case the CPR letter of claim inline with MiB protocols would have told the MiB that any contact or correspondence must be through them first otherwise it breaches the CPR (Civil procedure rules) requirements.

That sounds bad Bigty
I am not saying anymore.  Your choice or chosen for you by your insurers?

From the mib site this suggests it should be national and not regional.
3. Our investigations
The MIB will carry out its own investigations to establish the facts and assess any compensation that might be due. Our investigations are likely to include:

establishing the facts
obtaining statements from witnesses
obtaining a police report
contacting other bodies such as the DVLA and your insurer
We may appoint an investigator to come and see you and take a formal written statement.

The Untraced Drivers’ Agreement requires you to provide us with reasonable information and co-operation with our enquiries.

I am fully familiar with how the MiB work, I deal with them on nearly a daily basis.  But I assume that you also work in the industry, so happy to be corrected.

The process is the same for both the unisured track as well as the untraced track.

The MiB have 3 months to carry out their own investigation before they must admit or deny liability

But there are still protocols that have to be observed by both sides, and going through the claimants own legal representatives rather than via the back door is one of them.
