CAR ACCIDENT QUESTION???

OK, here we go, you ready ? I just wanted some advice from you hordes of delightful intellegent, knowledgeable people you…right, enough grovelling. here goes:

Bout 3 wks ago, my son was approaching a set of traffic lights, in his car? A car cuts across him to get to the front of him at the last min…ok, so hes calling her a silly so and so whatever, as we do…she pulls off and so does he…fine

All of a sudden she brakes hard cos she was speeding and saw the camera…hes seen the camera and brakes as well, but where SHE was going faster, hes “bumped” her car. So, they both get out and look at damage…none…so he has a go at her for being a stupid bitch etc…and they both go to their cars…

Only he notices she followed him? And as hes parked up and going to his friends, he can hear her on her phoning saying shes “scared” !!! He gives her a strange look and goes to his friends…end of

Cept the other day, he gets a letter from a solicitor stating they want his insurance details etc as their client is claiming for damages !! Shes already had her car “repaired” and did this through a solicitor and not insurance co !!!

Anyway, my sons insurance co sent a rep round to see the damage to his car…couldnt find any…(cos there IS none). Then they told him they will now send off to this bints solicitor and ask for the paperwork on what was done to her car, what damage shes claimed for etc.

My son, is wary he will lose his no claims now, which will affect his insurance, which is too high anyway and he was hoping next year it will be a bit cheaper…as hes not had any accidents before.

How can he be made at fault when hes got no sign of any damage to warrent HER having her car repaired? How can he be at fault if SHE braked so hard in front of him, he had no option but to lightly bump her car to stop (surely if he was going too fast or not paying attention he wouldve smacked right into her?) Ive been behind a car before who did the same to me, i was on my bike and i even bumped the back of their car as i had nowhere to go and although i braked it couldnt be helped?

Why did she have her car repaired BEFORE going to the solicitor to make a claim against my son? Why didnt she take particulars of my son at the scene, so that he could take hers too? (i did say he shouldve took pics but as he said, there was no damage, they both agreed to it and he thought that was that) i thought you had to have at least 2 quotes for repair first? Well you did last time that happened to me when i was stationary at a zebra crossing when someone ran into me? But this is different…he wasnt driving right up her ass, he did brake enough but it was her fault that he couldnt stop enough not to touch …its like us on bikes if someone stops dead in front of us…where do we go, if we dont want to swerve into the opposite lane and risk more serious injury?

Hes waiting on his insurance co and what they find out…what do you think? He will lose his no claims?

Unfortunatly going by the letter of the law your son is mainly at fault as he hit the car in front of him. That said both of them should have exchanged details when they stopped if there was a case of dammage or just to comply with road traffic act. As for getting her car repaired without going through insurance thats fine if it was cheaper than her excess - thats why her solicitor is conteacting you not her insurance. I would leave it to the insurance and her solicitors to work it out, he may well loose his no claims as being behind her and no witnesses…Although she may be a complete fruit loop and trying it on! get evidence of what ‘repairs’ she had done on headed paper from where she got it done.

:w00t:

I was about to say roughly the same thing - who ever hits the car in front is to blame no matter what the circumstances - unfortuantely, would have been good if he had taken pics of the no damage at the time - but we don’t tend to think of that at the time as we are normally so annoyed at whats just happened.

For what its worth, I think its a bit of her being silly (and vindictive) and a bit of your lad being silly (by possibly encouraging her to be vindictive by having a go).I’ve been in the situation where I was going around a roundabout in the right hand lane and an oldschool fiesta bumped into my fiesta, we got out, he said sorry and that his car was cold and it just jumped forwards, there was no damage and we both just walked away…but today I think people see car accidents as a gravy train, with compo being dished out left right and center, which in the end will come back to haunt us all as premiums go up and up and up.

I’ve always been told that if you hit the back of someone its your fault and that you are the persion laible and at fault as you should have been driving with correct observation and with the correct distance between you and the car in front and at the correct speed. (thats what id been told!)

What speed was she travelling at when she braked and what was the speed limit of the road? The reason i ask, is that lets say it was a 30 speed limit and she was going 40, for your son to have touched her, he must have been speeding too and must have been right up her backside. Unless his brakes are made of chocolate, he should really have been able to have stopped from 30 to 0 in a very very short distance.

It sounds like she is taking the **** and wants a bit of compo though. In terms of the “accident” which I’m sure she will be calling it, did your son and her exchange details? Is there any possibility of them claiming that he left the scene of an accident? I presume the police were not called or anything if it was a minor incident?

I’ve never heard of anyone getting the “work” done on the car and then requesting the claim, it sounds very odd! Best advice is probably going to come from the solicitor who will be an old hand at these kind of issues i think!

Seriously, they hardly touched, there is no damage to his car whatsoever? I know he hit her from behind and as he said, he had nowhere to go, the rep that came from the insurance co said he must have touched her car at less than 5 mph?My son said she braked so hard that there was no choice but to bump her and that he wasnt up her ass or he wouldve done more damage and smashed his car too. I said to be ready to lose his no claims…seems that nowdays if you want something repaired on ur car, go and do this sort of thing to them and u can end up with a complete new back end !! They didnt exchange any details as they both agreed it was “one of those things”…then she followed him to where he was going? Then got on her phone to someone saying she was scared for her life !!!His insurance co said its strange she got the work done first and then made a claim…they are sending out for results of what she had done to her car? They are also sending the same rep to see her car too…but he told my son that he cant see his car did any damage enough to warrent her having work done on it…

Like i said, probably a fruit loop looking for easy money :w00t:

Thing is, shes prob gonna win…he will end up losing his no claims and she ends up with the work she wanted done on her car all along and couldnt afford before this “accident”…stitch up aint the word !!

its pants mate, i symphathise with him and the NCB, its so important these days to keep it! :frowning:

I’ve heard of alot of ‘rigged’ accidents. A car brakes v hard infront of a buisness (say BT) vehicle or bus (most bus company’s now fit forward facing camera’s to their fleets). Then claims for all it’s worth. The company’s normally pay out without question. This has helped put up the cost of insurance across the board.

This insurance scam is favoured by the ‘less desirable’ members of our society as a quick buck winner. Untill very recently it has worked well.

I had some nugget clip the front of my old car on a small roundabout in W. Sussex about 2 yrs ago. He’d been sitting next to the roundabout waiting for some poor unsuspecting person to enter it. That person was me. I got out, checked my car, used a few choice words then told him I didn’t have time for his childish games and drove off (but did take his registration). When I got home, I told the rozzers but nothing came of it.

This sounds like she’s trying to get money from your son’s insurance. As mentioned, let them and the solicitors have the bun fight. That’s one of the reason’s we pay insurance.

Let us know what the out come is though, I’d be interested to know.

All the best for him anyway

ok as for the RUB on her car u son is at fault as he RUBED a stationary car.she should not have had the repairs done without the consent of her insurance as they would want to make a claim againts your son and it would have to be established that he was at fault + they would want reclaim the exses from your son.she had no write to do this off her own back.no agreement has been made with u son on a personal level to do these repairs, some people pay for minor repairs and call it quits.she would have to come up with some proof like pictures, damage parts a receipt will not be enough to stand any chance of getting paid.its sound like she has been ill imformed or she is trying to defruad your son and may ask for cash as a way out for him, tell to feck herself.u insurance sould see through all off this and tell her to go away.

I cant understand how she could claim if there were no witnesses or details exchanged at the scene. They spoke after the bump and agreed to go their seperate ways. Way I see it is its her word against his especially as hes got no damage to his car. Understand the scam but just cant work out how she could in any way say he was responsible and/or claim for non existant accident damage.

Her car wasnt stationary, she was going too fast and saw the speed camera and slammed on her brakes? Agreed she shouldnt have got her car repaired cos theres no proof of damage and no witnesses either ! so dont see how she can now claim it was him?

She didnt do it through her insurers either (the claim) shes gone to a solictor? Suppose she didnt want to lose HER NCB? I think shes trying to defraud big time, cos there was no conversation between her and my son, he says he had a go at her, then they agreed no damages so he drove off, but she then followed him, got on her phone and he could hear her saying shes scared for her life???:w00t:…

We are hoping his insurance co do the right thing…and not just put this down to his fault…no pictures were taken at the time it happened, and if she DID provide some, then she took them of her own car and not his, so again its not putting him in the picture of hitting her car as the insurance rep proved by his examination, theres no damage to his car whatsoever…

Cos apparently the law states if you hit someone from behind, its your fault…

why there is no exceptions, ie as in her case clearly trying to pull a huge scam (and will prob win, which sort of says she knows what shes doing, cos i wouldnt think of something like that off the top of my head), i just dont know…even when its blatently clear he didnt do her car any damage…shes got a mini my son a ford focus st !! who would be more worried about damaging their car, her or my son !! id like to give this biatch a slap but id get put away…sign of our good ol times eh? the good get done and the bad get away with scams every day…sure this aint sherwood forest with men in effing tights !!

I’m afraid your right Blade, if your honest you get screwed over, break the law, you get away with it. Chav’s n Pikies taking over!!!On a lighter note, maybe it’s the men around your area that are in tights!!! :hehe::hehe:

Well, erm, there ARE a few ?? but they leave mine alone so we wont talk about them… (esp when its cold and they want them for under leathers !!) :stuck_out_tongue:

Apart from this thread  what actual evidence is there that your son bumped her car. Without any evidence surely she has no case and your sons insurers will throw it out?

The insurance co rep who came to my sons workplace to take pics and examine his car, said looking at my sons car, which has normal wear and tear that u get, he mustve been going less than 5mph when they hit? Therefore he cant see how she can try or even MAKE a claim against him, esp when she agreed no damage at the scene. Shes obviously gone away and thought about it and got the whatever she wanted done to her car, done, and then gone to a solicitor and not her insurance co…if she also comes up with some kind of witness all of a sudden? shes lying again, thats the first thing i asked my son, and he said, “no one stopped, as there was nothing to see” and " no one came over and she didnt go and talk to no one except someone on the phone after she followed him when he drove off, and then stopped at his mates place"…so shes deffo pulling some scam.

My sons just told me that his insurance co said they have the details from the 3rd party, ive told him to ask them what it is shes claiming for and is she saying she has a witness…or has some “witness” written a statement…

At anytime you hit from one in front, it’s automatically your fault.

Blade - i would trust your insurance to do the best they can - but they don’t really want to pay out.

WOW !! hows this?Just had a call from my son, his insurance co has told him that the other party has refused for them to send their rep to examine her car and paperwork on what was done to her car !!!

He said they said something about it being an “admission of guilt”? They can provide proof his cars not damaged, but the others wont show proof of the supposed damage to her car !!! WTF !!

Hes now waiting as they said they are now going to fight this to the end !!

Wish i was there to help em fight, id like so smash her face in the lying cow !! Hope she gets done for this…too many people taking the pee…

I had an accident where I spun and got hit from behind and the person who hit me also was found not at fault despite not leaving enough space. Rationale, I caused the accident through my spin.

Regarding your son’s accident, the third party should have got the car assessed by the insurance company so that could be an angle you could use getting solicitors. I would’ve thought if left to the insurance company to sort out they’d most likely find your son at fault for hitting from behind. There are so many scammers out there!

I had an accident where I ran into the back of someone quite awhile back and I agreed liability and offered to pay for it without getting insurance companies involved to protect my NCB. The quote I got from them was ridiculous and so went through insurance, turned out the damage was half the amount they quoted me!! I would’ve been happy to pay them that amount but they were chancers looking for some extra dough.
