Agreed , where it’s an unavoidable accident, but this isn’t one of those.The evidence points to the fact that the lorry driver was distracted by using a laptop.In this case (as in all others where a death has been caused by careless or dangerous driving), I think a custodial sentence is wholly appropriate.
in jail this guy will learn nothing, he will come out, be back on the road in days, and may even committ exactly the same crime again, this is no good whatsoever
here is what I would prefer…

A period of re training and re testing…this may include some psychiatric investigation too…

A period of responsible community service. To repay some of his debt to society…

A period of financial compensation paid to the family of the deceased out of any income this guy earns over the next few months or years…

A final review to decide if this man is repentant enough to be allowed to go back to normal life…
This would then give us back into society a man who has properly paid his duty to society, who will have been shown the evils of his ways and will hopefully have learned not to do it again, and maybe THE LAW wont have destroyed his life and his families in the process…there is no need to destroy more lives after an accident…the deed is done, and emotion is should not be a part of the solution, its time to try to heal not continue destroying…

I agree with some of your points there however society does not need to be repaid I personally dont need anything from this careless individual, I do think that being locked up in a cell will give him sometime to think about his actions and how he has killed a family by faffing with his laptop while being in charge of a hgv.
absolutely no evidence that he will learn, over 70% of people who go to jail return…it doesnt do anything for anyone but costs us, the people, £35,000 per year to keep them in jail…dont see the point…
35,000 a year is a cheep price to pay if it keeps him off the roads never to commit this horrible homiside again
but thats the point, he goes to jail is out in a year or two with no retraining nothing learnt, he is an angry man, he is still with his licence, maybe his family have lost their home and he is pennyless, he becomes desperate and does what…drives again…nothing learnt and he is still a danger to other road users…its the wrong way…

I think there is no such thing as a good book, its all about opinion at the current time…things change but I do think your right that there is a point when we have to give up on people, some will never change and they serve no good to society…time for a good 13 coil knot…
How many of you use a sat nav, i’m not excusing what he has done but according to the news he was checking his route on the laptop not on a forum as people have somised. so i think i would agree with the jury on this one.
Under this new law of ‘Death by careless driving’ the maximum custodial sentence is 5 yrs! FACT. However, to get that you must have alot of mittigating factors - ie repeat offence, banned ect. As he’s the first person to be convicted under this new law, I feel he should have got the full 5 yrs as a ‘show case’.
Bearing in mind this prat (being polite) has not taken a DVLA approved test as he’s European. Then I’d ban him from UK roads as well as give the maximum 5yrs, and a fine.
In my mind, the legal system in this country is shot to hell.
Kill somebody behind the wheel - get a couple of years and ‘don’t do that again’.
Kill somebody accidently by almost any other means and you do more time inside.
The worst part of this hole nightmare, (for the family and friends) is how cheap the law sees human life.
I remember watching some traffic cop program which pulled a foreign lorry driver over who had a television on his dash whilst he was driving, watching Star Trek or something! Now I know long distance lorry driving can be a bit boring but that it just madness!
Any HGV lorry driver caught with a TV on, laptop, or anything that can cause a distraction should be banned from driving HGV’s for life.

The bloke needs to be punished, not given something (probably for free at the expense of the taxpayer) that people would normally have to pay to do! And yes, our justice system has been screwed up and flushed down the bog
