This morning I left the house thinking what a nice day it is. Decided to take the XT to work, the long way round through the Pirbright Bends. Right near the start of an awesome set of bends I overtake two cars to get a clear run, and as I cross back over the double white lines a cop car comes the other way, DOH! So I keep expecting the blue lights in my mirrors, but after a couple of miles still nothing so I assume that they didn’t turn around. Wrong! About another mile later the blue lights appear. So, fair cop, I was wrong and I take the £60/3 points on the chin. And I get a producer for the insurance docs…
I’ve had the bike just over a month now and haven’t received the docs yet, so I call Carole Nash. Can you see where this is going yet… “No sir, we don’t have any record of that vehicle being insured with us. We tried to call you, but couldn’t get hold of you.” I clearly remember giving the guy my card details over the phone on the morning of the day that I was going to pick the bike up, but now it seems the transaction never went through, and I’ve been driving without insurance and I have to produce my docs within 7 days.
No Transaction means no Insurance and no insurance means your nicked !! sorry mate but thats it unless you get some leniency but I doubt it…Imagine the amount of bull the police have heard in the past ?? even if you get insured now the dates will not be tracked back to cover you so…even though you are genuine I think this is a hard one…maybe some advice from our in house boys in blue ??
Even over the phone the message tells you that the call is being recorded for ‘Security and Training Purposes’ - the folks at Carole Nash are quite good usually - phone and ask to talk to a manager and explain your problem ( you could also hint that you hundreds of bikers on a motorcycle forum are watching what happens and this could be good / bad PR for Carole Nash…)
Hang on hang on hang on. These insewerance scum types say the same thing at the beginning of each call, dont they?? “Calls are recorded in case you’re a lying *******”, or words to that effect. So your dulcet tones must be on their audio devices somewhere, no??
Well, you need to write a nice polite letter to someone fairly senior at the insewerance co explaining the gravity of the situation you are in through no real direct fault of your own, and to try obtain a copy of the conversation which took place detailing the ‘transaction’.
Did you not get a reference number??
Are you 100% sure that you didn’t get the insewerence from someone other than carole nash?? 'Cos when plod stopped you, assuming they done a vehicle check, it’d flag up as “no insurance held”. But you said carole nash tried to contact you. Check on what number. And why.
I’ve already had some choice words with CN and they are now trying to trace the call that I made when I paid for the insurance - I don’t hold out much hope though, because they aren’t exactly going to give me evidence that they are wrong.
I want to stay squeaky clean on this one, but as Barro says, the law has probably heard it all before. Guess I will have to go to court and produce evidence that both my other vehicles are insured and that I tried to insure this bike (if CN will give me a letter to that effect). Hopefully they will see that I am an honest type and that I didn’t intentionally not insure it.
I tend to agree that you should be trying to get some kind of evidence from your insurers that you believed you were covered and that an error was made on their part.
Sorry to hear about this mate. Sounds like an absolute nightmare. I’m sure that teh traffic lads on here will give you some pointers but you are going to have to rely on CN admitting a mistake. Hopefully they will. Fingers crossed for ya.
My existing policies do give me 3rd party cover on other vehicles, but I’m not sure if that includes vehicles owned by myself, or only vehicles that I don’t own (and presumably have their own insurance)?
I once went out for a meal and the card reader in the restaurant was faulty, they tried twice to get it to go through and only managed it on the third attempt, I checked with my bank and they confirmed that I was showing two failed transactions !!!
This maybe your salvation mate, go in there and ask for a readout !!!
they changed the law on this recently, a number of people were insuring Renault 5’s then driving their Porches on 3rd party. The loophole has sadly been closed.
There may be some hope here, does anyone know if the producer requires me to demonstrate that the vehicle is insured, or that I am insured? If it is the later, I may be able to produce the insurance docs for the Gixxer which insures me 3rd party on other bikes (the PCN doesn’t reference whether I am the owner of the offending vehicle or not).

I also forgot our good friends, The Financial Services Authority. The new head is a pitbull with financial mis selling especially when they put innocent members of the public into trouble
Something a bit sneaky here…they will only check to make sure the docs are in order - so if yer really stuck do you have a certificate in your name but not specifying the vehicle?
That said, did you get any communication from carole Nash even a temporary covernote…they usually send out docs including a proposal form or statement of faqs with temporary covernote.
You might also want to check with the FSA (General Insurance regulators since 14th January 2005!!) and Ombudsman as given you arranged it over the phone and thought it was done; and that they tried to call (but obviously didn’t attempt it!!) they should have written to you as they must have had your address…think they still need to write to confirm what they are doing AND send recorded delivery as its motor insurance and has legal implications!!!
Whatever happens…make sure you have done all you can and can demonstrate it in court…they may show a bit of leniancy…na seeing the other posts on this type of thing…probably not, but you gotta try - good luck.
