Ambulance journey logs

Hi all - brand new here so be (relatively) kind!Need some advice and hoped that someone here might point in the right direction. Got a NIP for speeding on the A3. I think I know when this was - I had been tootling along at normal speeds, and I was accelerating in the outside lane past traffic driving in lane two in order to get a space to dive in to get out of the way of an ambulance on blues and twos coming up behind. Looks like I missed the camera - I was concentrating on not impeding the ambulance rather than speed.

Obviously hard to prove, because I can’t get the camera evidence that an ambulance went through just after me at well over the limit, so looking to see if I can get ambulance journey logs instead? The ticket is timed at 0750.

Any paramedics on here who might be able to help?

not sure about the logs BUT apparently thats no defence anyway.

I can vaguely remember an article about a motorist that tried to use a similar argument for going through a red light and it didn’t wash…

As long as it was an LAS ambulance and not one of the private ambulance services there are records kept of every journey made.
The only people that could probably help you out would be the PALS team

I don’t think that even with proof you were making way for an ambulance you would get the speeding ticket cancelled but good luck anyway and let us know how you get on :slight_smile:

Appreciate it is probably no defence, but I am in ban territory and want to try to mitigate it.

Anyone know why on the LSCP website it states that if you got a NIP you **WILL ** get a CFOP - no mention made of magistrates guidelines etc? Is this an error or is it the actual situation?

"If you have been caught by an LSCP speed or red light camera you will receive a letter from the Police within 14 days. This letter is called a Notice of Intended Prosecution (NIP). The NIP will ask you to confirm the identity of the driver at the time of the offence. The NIP form must be sent back to the Police within 28 days (to the Police address given).

If the NIP is received by the Police within the given 28 days, the driver of the vehicle will be sent a Conditional Offer of Fixed Penalty (COFP) . The COFP offers the driver the chance of paying a fixed penalty notice of £60 and accepting 3 points on their licence."

I don’t think there is a defence - strickly speaking you should have stuck to the speed limit and let the ambulance past when it was safe and legal to do so - but there is the issue of public interest. All legal action has to be in the public interest for it to be undertaken. Your argument will be that it is not in the public interest for you to be prosecuted for assisting an emergency vehicle make progress. The difficulty will be showing the ambulance was there - if it went through at speed it would also be flashed - the Freedom of Information Act should allow you to find out whether an ambulance was flashed within seconds of you. It is the logs that would then be used to get that ambulance driver off that charge.

Thanks all. I have applied to the LAS for the records, but I know I was technically wrong and will if it goes that far ask for mitigation. I’m a good boy honest…
