Just had this driver hitting me from the back so this is how it all went.
I am to the left of 1st lane behind transit van and there is a car behindme. Lights turned green van driver did not go at first all the other carswent and the he slowly moved and then bang. Car hit my side my left legmeets right the car by the front wheel (see picture). Thankfully car suddenlystops, few scratches on the car and my bike’s left footrest is broken – just alittle pressure on leg nothing major, no injury. I was in shock, couldnot believe what had just happened to me. I asked him to pull over to theside road. Driver claims I was on his blind side and he could not seeme. He questionably apologised. But I found it difficult to breathmy heart my over speeding. I asked to take a few moments and set down onthe footpath. woooooh I tell you man. scary stuff when you get hit like thisout of nowhere and unexpected. I could have lost my leg if moron didn’t stop in time or die even if he had pushed me in front of the other car on 2nd lane. Anyway he was in rush and keep asking mefor my phone number. He did not have hisinsurance details but gave me his number and said I can get a quote from themechanic and we can talk about this later. He may claim from the insurance orsettle it himself but will let his insurance know anyway.
What should I do? The damage is minor so I do not want to claim theinsurance as it may increase my insurance later on, is that right? They always ask you to disclose accident even if it was not your fault. Any suggestion on what my next steps should be will be helpful.
Also does anyone know a good place to get this checked andget quoted around NW London. Is Yamahadealer (its R6) any good for this. I think itis a simple part replacement.
I was dressed properly and surely one of the reason I didn’t have any serious injury.
I wouldnt claim on your insurance for that. Your premiums will be affected especially if you actually end up having a “real” accident at some point and they start to consider you as “accident prone”
I would call him and ask him to pay for the repairs…hopefully he has given you the correct contact details
Pleased you havent been seriously injured
From my experience, so long as the claim is made 100% from his insurance then you should be fine.
I saw very little difference on the online insurance comparison quotes when I declared “my bike hit, 3rd party found 100% at fault”.
Dealing with things outside of your insurance can be a dodgy. He might refuse to pay you and then when you do report it to your insurers they will be like “why did you leave it so long?”
Yes, I have his reg and correct phone number. I will get the quote asap and call him. Is it within 24hr that I must report an accident to my insurance? How about police report? as there are no injuries I doubt that is necessary.
police wouldnt want to get involve in this since there was no need an ambulance (nobody had serious injury)…thats from my experience back in the accident at end of March…
at least he did apologize when he got off the car… in my case, the old man swear at me when he got of the car lol… old man didnt see me coming when he tried to turn right from the juction…
Have been looking on ebay/google for this part. Can anyone help with the part number? it is w reg R6. Left hand front footrest fixing? As shown on the picture above, footrest itself is fine but where it gets attached is broken.
You are supposed to report an accident to the police within 24 hours, and usually as soon as is practicable…and I would if I was you do it as soon as possible, it should only take a few minutes, they will ask you to fill in a self-assessment form which don’t take that long, if the driver reports it and reports an entirely different set of events, then it will look bad for you when you come to describe the accident after that.
Also get the bike checked at a dealers to make sure that no further damage has been done.
Report it to your insurance company and give as many details as you can remember.
Inform them that the person has offered to settle if the damage is as minimal as it first appears without involving an insurance claim.
If it is JUST a footrest and the cost is minimal and he is happy to pay, that will be the end of that, but if it is not minimal and something has been bent then you will need to have that fixed and if things go pear shaped in the future, you will be covered because you have done everything the way you were supposed to do it.
Okay so I reported to the police. Police gave me a form to fill and then stamped it; for my record only. Bike repaired. Cost £90. I paid and he agreed to pay as long as that’s everything. So let’s hope the money comes as well.
Kaos: thanks for your input. Still a bit unsure about reporting to the insurance to be honest. They always seems to be looking for any excuses to up my premium. What is at stake here… It’s very unlikely that he will turn around and say you damaged my car, or is it? doubt it because where the dent is on his car it will be hard to justify that I hit the car. How wrong am I?
Fairly sure you DON’T have to report it to the Police. Now I may be wrong, in which case maybe one of the Police who post on here can correct me, but I’ve never reported an accident to the police. Even when Police have turned up after the fact they’ve treated it as something which they don’t need to get involved with.
There are 3 types of accidents that require reporting within the Met Police Area (within 24 hours)
1 - Personal Injury Accidents
2 - Where one of the vehicles involved has failed to stop
3 - Where details have not been exchanged at the scene
If there is only damage to the vehicles involved you do not have to report the accident to police. The other driver can say what he likes about how the accident happened… there’s not much the police would be able to do anyway with no independent witnesses and having not been at the scene.
I agree with all the other advice though! If the driver does start to contest your claim or fails to pay for the repair at least you have your insurance company to fall back on!
