ok, slowly filtering down edge ware road, the traffic is pretty much at a stand still with the occasional person who can move about a foot before stopping again.
tesco delivery van pulls out (maybe to avoid hitting a parked car or other obstacle) without checking his wing mirror aaaaand splat.
i take a pretty hard slam on my left side and bike decides to lay down for a bit.
as the bike fell, the screen and tail end hit a small van on the other side of the road as well.
both drivers stopped to help me and give there information ect.
police came and asked if i was injured ect, nothing broken but my left shin got bludgeoned by my snapped fairings.

could have been a lot worse.
it terms of fixing / who was right, who was wrong ect.
people will argue for an eternity on bikes being allowed to filter and people checking mirrors ect, the guy seemed nice enough and pretty genuine so hopefully ill get it all repaired at tesco’s expense and they can deal with him how is necessary for the company.

if your wondering about what sort of speeds we were doing, he was in stand still traffic and i had just emurged from about 3 cars behind him and was filtering at about 12mph, after slamming the brakes on i was probly only doing about 5mph on impact.

as this is an edit i would like to thank you for the well wishes and the hopes of a quick fix. im also hoping for a quick fix!

so by the time i was taking pictures the tesco van had moved, this is how the bike landed against the other van.

this was the poor guy who had just started his night shift.

gutted for you, but as mentioned at least your OK, plastic can be replaced, you cant! I work for BT and if we ever had a prang in the vans it was a very easy and quick resoloution for the 3rd Party and the best thing is as its a blanket insurance cover it never affected our personal insurance policies as we didn’t make the claim aginst us personally so if Tesco’s is the same then the bloke shouldn’t be that worried about accepting responsibility as it won’t affect him and also Tesco being such a huge company they won’t do anything to him (sack etc) if it is his first accident. at BT you have to do a Computer based training course once you’ve had 2 or more accidents and thats about t!

Bad luck Shaun and GWS. Its a learning curve out there no matter how long you’ve been riding and self preservation is the name of the game. On the plus side Craptobers nearly over.

You don’t mention whether or not the Tesco van driver came out of his lane or, if he signalled or, if you were filtering in the lane or in the hatched area. However, in any event, it’s most likely that you’ll have to accept the lions share of the blame if not all of it because you should have seen the parked car or other obstacle and realised the van would have to pull out to pass it. Also you were approaching a traffic light and keep left bollard, therefore you should have been planning to rejoin the flow of traffic rather than pull out and filter past it.

BTW - I work for the largest fleet operator in the UK and our insurers log all motoring incidents against the driver and we are advised that any claims arising from own fault incidents while driving company vehicles must be declared to our personal insurers. I’m fairly certain this would now also be the same with Tesco and others. I’ve also worked for companies where the insurance excess on own fault incidents is the responsibility of the driver of a company vehicle.

i’e not had a work van for 2 years now and not had a prang in a works vehicle for over 3 years so it’s probably changed from when i was on the road.

he did in fact come out of his lane, he did not signal and i was by his front wheel arch at the time which is why i did not have time to react. i was filtering in the hatched area outside of the door zone (there’s that self preservation thing you where talking about ;).

as i mentioned, the speeds where very slow ect and whilst i would agree that a certain amount of forward planning on my part could have made me think that a van that was stationary would pull in front of me, surely in the same thought…his forward planning should have included a mirror check AND a blind spot check considering he was in a 7.5T van.
even so, i know he didn’t do it on purpose and i know i didn’t. it is exactly what we have insurance for, an accident.

You may be approaching a six of one and half a dozen of the other area. However, the Tesco van drivers insurers and the insurers of the oncoming van will make as much as they can from the fact that you, possibly unnecessarily, entered a hatched off area.

I’m not taking sides here, just pointing out it is not so clear cut.

quote] i know your not taking sidesand i also know they will try and hang me. its part of what we sign up for when we get on a bike. just contacted daytona and they said i can bring the bike in amd it will be assessed and estimates given for free. i do like the guys there :slight_smile:
